TOTAL ALLOWABLE CATCH DETERMINATION – 2009/2010 SEASON

The Australian Fisheries Management Authority makes the following Determination under section 11 of the Macquarie Island Toothfish Fishery Management Plan 2006.

Citation

1.       This Determination may be cited as the 2009/2010 MITF TAC D4 Determination.

Commencement

2.       This Determination commences on the day after registration on the Federal Register of Legislative Instruments.

Interpretation

3.       A term used in this Determination that is defined for the purposes of the Macquarie Island Toothfish Fishery Management Plan 2006 has the same meaning in this Determination as it has in that Plan.

Determination of total allowable catch

4.       The total allowable catches for the season in the Macquarie Island Toothfish Fishery which commences on 1 July 2009 and which will end on 14 April 2010 are:

Target species: Patagonian toothfish (Dissostichus eleginoides)

Aurora Trough                 60 tonnes

Macquarie Ridge             150 tonnes (of which 66 tonnes may be taken using the trawl fishing method with a trigger TAC of 175 tonnes*)

* the 175 tonnes is triggered if trawl catch rates reach a threshold of an average catch rate of 10 tonnes/km2 over 3 consecutive fishing days and revert back to 66 tonnes if catch rates were to fall below this rate, or, if more than 66 tonnes had been taken, the Macquarie Ridge would be closed to trawl fishing.

Bycatch Species

200 tonnes for all bycatch species combined with a 50 tonnes limit on any one species.
