MACQUARIE ISLAND TOOTHFISH FISHERY DIRECTION No. 1 OF 2011

PROHIBITION ON THE USE OF FISHING METHODS OTHER THAN TRAWLING OR LONGLINING

I, JAMES FINDLAY, Chief Executive Officer of the Australian Fisheries Management Authority, as delegate under delegation No. 1 of 2011 made on 28^th January 2011 from the Commission, make the following Direction under subsections 41A(2) and 22(5) of the Fisheries Management Act 1991.

Citation

1. This Direction may be cited as the Macquarie Island Toothfish Fishery Direction No.1 of 2011.

Commencement

1. This Direction commences the day after it is registered on the Federal Register of Legislative Instruments.

Period of Application

1. This Direction applies for the period beginning on the date this Direction commences and ends at the end of 14 April 2016 unless earlier revoked.

To Whom This Direction Applies

1. This Direction applies to a holder of a fishing concession in the Macquarie Island Toothfish Fishery and to a person acting on behalf of the holder.

[Note: This means that the Direction does not apply to a person if the person is fishing in the area of the Fishery in accordance with a fishing concession that is subject to another plan of management in force under the Act, under a scientific permit, a permit issued in another fishery, or under a licence issued under a law of a State or Territory.]

Interpretation

1. A term used in this Direction that is defined in the Macquarie Island Toothfish Fishery Management Plan 2006 (the Management Plan) has the same meaning in this Direction as it has in the Management Plan.

Direction not to engage in fishing

1. Fishing is not to be engaged in in the Macquarie Island Toothfish Fishery.

Exemption to the Prohibition on fishing in clause 6

1. The prohibition in clause 6 does not apply to a person fishing with the methods known as trawling or longlining.

Condition

1. It is a condition of all fishing concessions to which this Direction applies that the holder, or a person acting on behalf of the holder, complies with this Direction.

Revocation of Direction No. 1 of 2006

1. This Direction revokes Macquarie Island Toothfish Fishery Direction No.1 of 2006.
