Application for approval of the Macquarie Generation Enterprise Agreement 2012.

[1] An application has been made for approval of an enterprise agreement known as the Macquarie Generation Enterprise Agreement 2012 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). The Agreement is a single-enterprise agreement.

[2] The applicant has provided written undertakings. A copy of those undertakings is set out in Annexure “A”. Pursuant to s.191 of the Act, the undertakings annexed to this Decision are taken to be a term of the Agreement.

[3] Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.

[4] The Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (CEPU), the Construction, Forestry, Mining and Energy Union, Mining and Energy Division, NSW Energy District Branch (CFMEU), the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union" known as the Australian Manufacturing Workers' Union (AMWU), the Australian Institute of Marine and Power Engineers, New South Wales District (AIMPE) the Community and Public Sector Union-SPSF Group, New South Wales Branch (CPSU), the Association of Professional Engineers, Scientists and Managers, Australia (APESMA), and the Australian Municipal, Administrative, Clerical and Services Union - New South Wales Local Government Clerical, Administrative, Energy, Airlines and Utilities Branch, being bargaining representatives for the Agreement, have given notice under s.183 of the Act that they want the Agreement to cover them. In accordance with s.201(2) I note that the Agreement covers these organisations.

[5] The Agreement is approved and in accordance with s.54 of the Act shall operate on and from 15 January 2013. The nominal expiry date of the Agreement is 31 December 2016.

APPLICATION BY MACQUARIE GENERATION FOR APPROVAL OF ENTERPRISE AGREEMENT – UNDERTAKING AS TO SALARY RATES FOR ADMINISTRATION OFFICERS

We refer to our application for approval of the Macquarie Generation Enterprise Agreement 2012 (Agreement) filed at Newcastle.

The Agreement was made on 19 December 2012. The access period for the Agreement commenced on 7 December 2012.

Following commencement of the access period, it became apparent to Macquarie Generation that certain categories of Administration Officer would receive less than a 3.5 per cent pay increase under the salary tables set out at Appendix B of the Agreement. This was because the average pay increase under the Agreement – 3.5 per cent – did not equate to a 3.5 per cent increase for every employee. The affected employees are:

● Power Station Administration Officers receiving GPA 3, at salary levels ADMIN19 and above.

● Lambton Administration Officers receiving GPA 4, at salary levels ADMIN12 and above.

Macquarie Generation undertakes that employees who did not receive at least a 3.5 per cent pay increase in the first year of the Agreement will have their salaries adjusted upwards to be equivalent to an increase of at least 3.5 per cent. The higher salary rates for the affected Administration Officers are set out in the attached, revised version of Appendix B to the Agreement, marked “Appendix B1”.

In the event the Agreement is approved, Macquarie Generation respectfully requests that Fair Work Australia accept the above undertaking and append this letter and the attached “Appendix B1” to the decision approving the Agreement. In the alternative, Macquarie Generation respectfully requests that Fair Work Australia note the above undertaking and append this letter and the attached “Appendix B1” to its decision approving the Agreement.

A copy of this undertaking will be provided to Unions NSW and the union and employee bargaining representatives for the Agreement.
