JUDGMENT

HIS HONOUR:  In this matter there is a difference between the parties which is attributable to the site's having been relocated from one local government area to another.  Therefore with the consent of the parties there will be set down for the 13th of October 2006 the hearing of a preliminary point regarding which planning scheme was applicable at the time of Mr MacPherson's development application.
