HER HONOUR:   I have before me an ex parte application for leave to issue a proceeding brought by Mr Mackintosh.

On 1 August 2008 Justice Heydon, acting pursuant to rule 6.07, directed the Registrar to refuse to issue or file an application without the leave of the Justice first had and obtained.

Mr Mackintosh applied for leave on 8 September 2008 and the matter came before me.  I refuse leave to issue the proceeding.  I publish my reasons.
