Short title 1. These by-laws may be cited as the Mackay Port Authority Amendment By-laws 1991. Amended By-laws 2. The Mackay Port Authority By-laws 1988 are amended as set out in these by-laws. Amendment of by-law 1.5 (Interpretation) 3. By-law 1.5— insert “passenger cruise liner” means a vessel exceeding 1000 tons gross registered tonnage that enters the Harbour for the purposes of the embarkation or disembarkation of passengers; ’. Amendment of by-law 5.3 (Application for berth) 4. By-law 5.3, Forms 2 and 3 in the Schedule— omit . Replacement of by-law 5.32 (Vessels to obtain clearance) 5. By-law 5.32— omit , insert ‘Vessels to obtain clearance ‘5.32.(1) The master of a vessel in the Harbour must not take or attempt to take the vessel to sea except in accordance with a written clearance given by the Piermaster. ‘(2) The clearance must indicate if a pilot or exempt master for the Harbour is required to be on board the vessel when the vessel is taken to
3 Mackay Port Authority Amendment By-laws 1991 sea. ‘(3) The Piermaster must not give a clearance unless— (a) all harbour dues and any other moneys payable to the Authority in respect of the vessel’s stay in the Harbour have been paid; or (b) satisfactory arrangements have been made with the Authority for the payment of the harbour dues and other moneys. ’. Amendment of by-law 7.3 (Tonnage Rates and Mooring dues on vessels) 6. By-law 7.3— after every vessel , insert , other than a passenger cruise liner, ’. Amendment of by-law 7 (Schedule “A”) 7. By-law 7, clause 1 of Schedule A— after 150 tons gross register, , insert other than passenger cruise liners, ’. Amendment of by-law 7 (Schedule “B”) 8. By-law 7, item 12 of Schedule B— omit , insert 12 Rectified spirit, industrial alcohol and similar products, pumped to or from shore terminals by pipeline (per kilolitre) . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . 1.10 ’. Certificate These by-laws were made by resolution of the Mackay Port Authority passed on 23 August 1991 at a special meeting of the Authority called for that purpose.
