AN ACT to amend the Machinery Safety Act 1974.

[Assented to 29 November 1984.]

RE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent

of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. (1) This Act may be cited as the Machinery

Section 29

amended. 2. Section 29 of the principal Act is amended by inserting at the end of subsection (1) the following

" Penalty: $2 000. ".

Section 46

amended.

3. Section 46 of the principal Act is amended by

inserting at the end of the section the following

C' Penalty: $2 000, or imprisonment for 6

months, or both such fine and

imprisonment. ".

Section 58

amended. 4. Section 58 of the principal Act is amended by

inserting at the end of each of subsections (1) and

(3) the following

C' Penalty: $1 000, and if the offence is a

continuing one a further fine of $50 for every day on which the offence has continued. ".

Section 79

amended.

Section 79 of the principal Act is amended

(a)

by inserting after subsection (1) the following subsection

(1a) Proceedings for an offence against section 69 or section 70 may be commenced at any time within 2 years after the offence was committed and not afterwards. "; and

(b)

in subsection (2) by deleting "such proceedings" and substituting the following

proceedings in respect of offences

against this Act ".

6. The provisions of the principal Act referred to in the Schedule to this section are amended by inserting at the end of each of those provisions the following-

penalties Inserted.

Penalty: $400 and if the offence is a continuing one a further fine of $50 for every day on which the offence has continued. ".

7. The principal Act is amended by deleting in the provisions referred to in column 1 of the table hereunder the penalties respectively set out in column 2 and substituting in each case the corresponding penalty set out in column 3.
