AN ACT to amend the Machinery Safety Act 1974

and for related purposes.

[Assented to 27 May 1982.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent

of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. (1) This Act may be cited as the Machinery

and citation.

Safety Amendment Act 1982.

(2)

In this Act the Machinery Safety Act 1974 is

of 1974.

referred to as the principal Act.

(3) The principal Act as amended by this Act

may be cited as the Machinery Safety Act 1974-1982.

Section 33

amended.

2. Section 33 of the principal Act is amended

(a)

in paragraph (a), by deleting "relates; or" and substituting the following-

" relates; " ;

(b)

in paragraph (b), by deleting "Act." and substituting the following-

" Act; or " ; and

(c)

by inserting after paragraph (b) the follow- ing paragraph-

" (c) in the course of giving evidence in

any judicial proceedings. " .

Section 34

amended.

3. Section 34 of the principal Act is amended

(a) by repealing subsection (1) and substituting

the following subsection

i t

(1) Subject to subsection (2) of this section, inspection documents, certifi- cates and other records held by the Chief Inspector shall be open to inspection, without charge, by

(a)

the owner of the machinery to which those records relate;

(b)

any person authorized in

writing by the owner; and

(c)

any person authorized in

writing by a coroner,

but shall not be open to inspection by

any other person. " ;

and

(b)

in subsection (2), by inserting after "by any person," the following-

" other than a person authorized in

writing by a coroner, " .
