GUMMOW J:   This appeal from the Court of Appeal of the Supreme Court of New South Wales was heard in Canberra on 12 June 2008 by a Bench comprising Justices Kirby, Hayne, Heydon, Kiefel and myself.  The Court published its orders on 7 August 2008 allowing the appeal and today publishes its reasons for those orders.  Justices Kirby, Hayne, Heydon and I joined in the orders and publish our joint reasons.
