FRENCH CJ:   These appeals were heard in Canberra on 5 and 6 November 2008 by a Court constituted by Justices Gummow, Hayne, Heydon, Kiefel and myself.  On 2 April 2009, the Court handed down judgment dismissing each appeal with costs. 

On 30 November 2009, the parties filed a consent to the making of an order in the following terms:

Order 1 made by this Court on 2 April 2009 be amended by adding the words “against the First Respondent” such that it reads as follows:

1.        “Appeal allowed with costs against the First Respondent”. 

Pursuant to Rule 8.04.3 of the High Court Rules, I direct the Registrar to draw up, sign and seal an order in accordance with the terms of the consent.
