Case

LUPPINO

v

COMMISSIONER OF THE AUSTRALIAN FEDERAL POLICE & ANOR

[2021] HCASL 132
A18/2021

  1. The applicant has not identified a question of law sufficient to warrant the grant of special leave to appeal against the decision of the Full Court of the Federal Court of Australia (Wigney and Abraham JJ, Besanko J dissenting in part) allowing the first respondent's appeal against a declaration by the Federal Court of Australia (White J) that the order made by the second respondent on 30 August 2018 under s 3LA of the Crimes Act 1914 (Cth) with respect to the applicant was invalid. It would not be in the interests of justice generally or in the particular circumstances of this case to grant special leave.

  2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
