Lumascape Lighting Industries Pty Ltd v Vertex Lighting Inc

Lumascape Lighting Industries Pty Ltd sought a declaration from the Queensland Supreme Court that California was the most appropriate jurisdiction to determine a dispute with Vertex Lighting Inc. The applicant also sought an order that the Queensland Supreme Court dismiss the proceeding for want of prosecution and an order that the proceeding be stayed. The applicant claimed that the proceeding was vexatious and an abuse of process. The legal issues before the court were whether the Queensland Supreme Court had the jurisdiction to determine that California was the most appropriate jurisdiction to determine the dispute and, if so, whether the Queensland Supreme Court ought to determine that question. The court held that the Queensland Supreme Court had the jurisdiction to determine the question of most appropriate jurisdiction, however, it was not appropriate for the Queensland Supreme Court to determine that question. The court held that the proceeding was not vexatious or an abuse of process and the application was dismissed. The court found that the proceeding should not be dismissed for want of prosecution or stayed.
