This application for removal into this Court of the whole of a cause of action now pending in the County Court of Victoria does not raise any "cause or part of a cause arising under the Constitution" sufficient to fall within s 40 of the Judiciary Act 1903 (Cth). The application is manifestly hopeless. It is an abuse of process and should be dismissed.
Pursuant to r 26.07.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
