The said JOHN MOFFAT and GEORGE CAMPBELL YOUNG in their capacity as Liquidators and also personally do hereby jointly and severally covenant and declare that they are and that each of them is duly empowered and entitled to enter into this Agreement and to make and perform the terms conditions covenants and stipulations herein contained and that they and each of them will enter into and procure all consents agreements writings and undertakings which the Minister shall reasonably consider neces- sary proper and sufficient to carry this Agreement into full effect and no part of the said sum of Seventeen thousand five hundred pounds shall be payable to the Liquidators until or. unless the Minister is satisfied that the same have been entered into and procured. [ASSEN'l'ED 'I'O 5TH DECEMBER, 1916.] Preambl~ . W HEREAS pursuant to "The ·Harbour Dues Act of 1892"* all moneys received under the authority of the said Act in respect of the Harbour of Dungeness have from time to time been placed to the credit of a Trust Account, called "The Dungeness Harbour Dues Trust Account," and after payment of all sums incurred for the management and improvement of the said Harbour there is now standing to the credit of the said Accoup.t the sum of three thousand five hundred and fifty-six pounds or thereabouts, and no part of the same is im- mediately required for constructional improvements in the said Harbour: And whereas the construction of a road from Lucinda Point to Halifax is urgently needed and would be of great advantage to the said Harbour: and whereas the estimated cost of the said road is three thousand seven hundred and forty pounds or thereabouts: and whereas doubts have arisen whether any part of thE' moneys of the said Account can lawfully be applied * 56 Vie. Lucinda Point to Halifax Road Act. towards the cost of the construction of the said road, and it is expedient that such moneys should be so applied: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of Queens- land in Parliament assembled, and by the authority of the same, as follows :- 1. This Act may be cited as "The Lucinda Point to Short title. Halifax Road Act of 1916." 2. (1.) Notwithstanding anything contained i~ "The ~ as: rer . Harbour Dues Act of 1892"* or in any othel' Act, It shall mo~ ey~ Por be lawful for the Treasurer to apply the amount now ~ 1m~ eness standing to the credit of "The Dungeness Harbour Dues Du~ s T~ t Trust Account" towards the cost of the construction of Account to a road from Lucinda Point to Halifax. ~ ~ : d~ ct a (2.) Such moneys shall be applied by instalments as the work proceeds to the satisfaction of the Treasurer. (3.)
