  1. The applicant requires an extension of time, but it would be futile to grant the extension which is sought. 

  2. The application for special leave to appeal does not raise any question of general importance but concerns a matter of practice and procedure.  It would not be in the interests of justice generally, or in the particular circumstances of this case, to grant special leave.  Special leave should be refused with costs.

  3. The first respondent seeks an order for indemnity costs.  No sufficient reason has been shown for ordering that the costs which are to be allowed against the applicant should be allowed on an indemnity basis.

  4. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
