Lotteries Gaming and Betting (Corresponding

Offences) (Amendment) Regulations 2001

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to amend the
Lotteries Gaming and Betting (Corresponding

Offences) Regulations 1997 to—

(a)

declare further laws of other States and Territories to be laws that correspond to section 18, 23 or 66B of the Lotteries Gaming and Betting Act 1966; and

(b)

declare certain laws of other States and Territories to be laws that correspond to section 66A of the Lotteries Gaming and Betting Act 1966.

2. Authorising provision

These Regulations are made under section 86 of the Lotteries Gaming and Betting Act 1966.

3. Principal Regulations

In these Regulations, the Lotteries Gaming and Betting (Corresponding Offences) Regulations 19971 are called the Principal Regulations.

4.  Additional corresponding laws for the purposes of section 18(1A) of the Act

In regulation 4 of the Principal Regulations—

(a)

after paragraph (b) insert— "(ba) sections 31, 32, 33, 35 and 36 of the

Unlawful Gambling Act 1998 of New

South Wales;";

(b)

in paragraph (i), for "Western Australia." substitute "Western Australia;";

(c)

after paragraph (i) insert— "(j) section 27 of the Betting Control Act

1954 of Western Australia.".

5.  Additional corresponding laws for the purposes of section 23(2) of the Act

In regulation 5 of the Principal Regulations—

(a)

after paragraph (b) insert— "(ba) sections 8 and 9 of the Unlawful

Gambling Act 1998 of New South

Wales;";

(b)

in paragraph (g), for "Western Australia." substitute "Western Australia;";

(c)

after paragraph (g) insert— "(h) sections 24(1) and 26 of the Betting

Control Act 1954 of Western
Australia.".

6. Insertion of new regulation 5A

In the Principal Regulations, after regulation 5
insert—

"5A. Corresponding laws for the purposes of

section 66A(4) of the Act

For the purposes of section 66A(4) of the Act, the following laws are declared to be laws that correspond to section 66A of the Act—

(a) section 31 of the Racing Administration Act 1998 of New South Wales;
(b) section 22 of the Unlawful Betting Act 1989 of the Northern Territory of Australia;
(c) section 220 of the Racing and Betting Act 1980 of Queensland;
(d) section 105 of the Racing and Betting Act 1952 of Tasmania;
(e) sections 84A, 84G and 84H of the Police Act 1892 of Western Australia.".

7.  Additional corresponding laws for the purposes of section 66B(5) of the Act

In regulation 6 of the Principal Regulations, after
paragraph (b) insert—

"(ba) sections 15 and 19 of the Unlawful

Gambling Act 1998 of New South Wales;".
