AN ACT to amend the Lotteries (Control) Act 1954.

[Assented to 19 December 1984.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. (1) This Act may be cited as the Lotteries

and principal

(Control) Amendment Act 1984.

This Act shall come into operation on a date

to be fixed by proclamation.

Section 9

amended.

3.

Section 9 of the principal Act is amended

(a) in subsection (1b)—

(i)  in paragraph (a) by deleting "Recreation, who shall distribute" and substituting the following-

" Sport and Recreation, who shall distribute or cause to be distributed "; and

(ii) in paragraph (b)

(A) by deleting "Cultural Affairs, who shall distribute" and substituting the following-

" the Arts, who shall distri- bute or cause to be distributed "; and

(B) by inserting after "activities"

the following-

" and persons engaged in

cultural activities ";

(b) in subsection (1c)—

(i)  by deleting "Recreation and the Minister for Cultural Affairs" and substituting the following

Sport and Recreation and the

Minister for the Arts "; and

(ii)   by inserting after "fit" the follow- ing

" and such persons or bodies may

be paid, out of the moneys

received in respect of instant

lotteries conducted by the Com- mission under this Act, such remuneration and allowances as are determined by the relevant Minister to be appropriate ";

(c)

by inserting after subsection (1c) the following subsection

'C (lca) The Minister for Sport and

Recreation and the Minister for the Arts may, for the purpose of distribu- tion of moneys under subsection (lb), make use of such persons, bodies or departments of the Government as they think fit and such persons, bodies or departments shall be paid, out of the moneys received in respect of instant lotteries conducted by the Com- mission under this Act, such of the costs and expenses of that distribution as are determined by the Minister to whom the administration of this Act

is for the time being committed by the

Governor to be appropriate. "; and

(d)

in subsection (1d), by deleting "after deduction of the expenses referred to in paragraph (e) of subsection (1), payment of the prize moneys and the moneys required to be paid into the Account" and substituting the following

i t

after

(a)

payment of the prize moneys;

(b)

deduction of the expenses referred to in paragraph (e) of subsection (1);

(c)

payment of the moneys required to be paid into the Account;

payment of the remuneration and allowances referred to in subsection (lc); and

(e)

payment of the costs and expenses referred to in sub- section (lea); ".
