AN ACT to amend the Lotteries (Control) Act,

1932-1950.

BE it enacted by the King's Most Excellent

Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

Short title.

1.

This Act may be cited as the Lotteries (Control) Act Amendment Act, 1951, and shall be read as one with the Lotteries (Control) Act, 1932-1950 (Act No. 50 of 1932, as amended by Acts Nos. 39 of 1933, 33 of 1934, 24 of 1935, 35 of 1936, 53 of 1937, 46 of 1938, 18 of 1939, 31 of 1940, 30 of 1941, 27 of 1942, 15 of 1943, 38 of 1944, 44 of 1946, 7 of 1947, 69 of 1948 and 51 of 1950), referred to in this Act as the principal Act.

4. Section three of the principal Act is amended ?:..3

adding after the word, "shall" in line one of paragraph (e), the words, "subject to the provisions of this section";

substituting for the second proviso to para- graph (f) the following:

Provided that on and from the first day of January, one thousand nine hundred and fifty-two, the aggregate fees payable to all the members in any one year, com- mencing on the first day of January, shall not exceed one thousand seven hundred pounds, of which sum the chairman shall be entitled to receive nine hundred pounds, and the remaining three mem- bers, a sum not exceeding two hundred and sixty-six pounds thirteen shillings and fourpence.;

(e)

Adding after subparagraph (iii) of para- graph (g), the following subparagraph—

(iv) dies or resigns;

(f)

substituting for the words, "one year's" in lines four and five of paragraph (i), the words, "term of".

6. Section six of the principal Act is amended by substituting for the word, "shall" in line one of paragraph (a), the word, "may".

7. Subsection (4) of section eight of the principal Act is amended by adding after the word, "drawing" in line fourteen, the words, "but where through circumstances beyond its control the Commission is obliged to postpone the date of the drawing in respect of a lottery, notification so given shall be deemed to include notification of the postponement and it shall not be necessary to give further notifica- tion of the postponement".

8. Paragraph (d) of section ten of the principal Act is amended by

(a)

adding after the word, "account" in line twenty-three, the words, "or invested by the Commission in Commonwealth Inscribed Stock";

(b)

adding after the word, "may" in line twenty-four the words, "together with any accretions thereto by way of interest or profit on sale of Commonwealth Inscribed Stock".

9. Paragraph (e) of section eleven of the prin- cipal Act is amended by adding after the word, "drawing" in line three, the words, "but where through circumstances beyond its control the Commission is obliged to postpone the date of drawing in respect of a lottery, notice so given shall be deemed to include notice of the postponement and it shall not be necessary to give further notice of the postponement".

10. Subsection (2) of section fifteen of the prin-

cipal Act is amended by

(a)

adding after the paragraph designation (d) the figure "i" in brackets, thus "(i)";

(b)

adding to paragraph (d) the following sub- paragraphs:—

(ii)    The Commission may for the purpose of furnishing accounts in accordance with the provisions of this paragraph elect to conduct a number of lotteries as a group.

(iii)    Where the Commission conducts a group of lotteries, the requirements of subparagraph (i) of this paragraph shall be regarded as being complied with if the Commission, instead of furnishing the account within thirty days of the drawing of each of the lotteries comprising the group, fur- nishes a composite account of all lotteries comprising the group within thirty days of the completion of the drawings of the group.;

(c) adding the following paragraph:

(g) (i) The Commission may pay out the prize money payable in respect of a prize-winning ticket on receipt of the ticket purport- ing to be endorsed by the person purporting to be the holder of the ticket with his signature and address.

(ii)   The Commission shall not be obliged to satisfy itself that the person purporting to be the holder of the ticket is the lawful holder of the ticket, that the signature is genuine, or that he is not an infant or person under other legal disability.

(iii)    Notwithstanding any law to the contrary, whether relating to infants and persons under other legal disability or otherwise, pay- ment of prize money by the Commission pursuant to the provisions of this paragraph, shall constitute full satisfaction by and a full and valid discharge to the Commission.
