LOTTERlES COMMISSION (MIDWEEK LOTTO) RULES 1995

Made by the Commission under section 28 (1).

PART 1 - PR;ELIMINARY

Citation

1.      These rules may be cited as the Lotteries Commission (Midweek Lotto)

Rules 1995.

Commencement

2.      These rules come into operation on the day on which the Lotteries

Commission (Saturday Lotto) Rules 1995 come into operation.

Interpretat ion

3.      In these rules -

"agent" means a person authorized by the Commission to process entry

coupons;

uAustralian Lotto Bloc" means a grou made up of the Commission and the designated

authorities in re 7 ation to -

(a) the State of Queensland;

6 )      the State of South Australia; and

(c)
the State of Victoria;

"claim period" for a midweek lotto draw means the period of time from the draw to the close of business -

(a) on the second Thursday after that draw; or

where the second Thursday after that draw is a public

6 )      holiday, on the preceding business day before that

Thursday;

ugame" means -

(a)

in relation to midweek lotto a single entry in which between 4 and 20 numbers inchive out of 45 are selected, and which, individually, may constitute part, or all, of a lotto coupon;

(b) in relation to a system entry, the notional multiple games

making up that single system entry;

(c) in respect of a super 66 draw, a single 6 di 't number
coupon; selected, of which one or more may be enter 2 per entry

"midweek" means Thursday evening;
"midweek lotto" means a game of lotto conducted in accordance with

these rules;

"midweek lotto draw" means a lotto draw which involves the mechanical, equally random selection of 8 numbered balls selected from balls individual1 numbered from l to 45 inclusive, determines to be adequate, which takes place midweek; in a manner and using suet equipment as the Commission

"payout period" means the period from the Friday after that midweek draw to the close of business one year from that draw;

"prize pool" means -

(a) for a midweek draw, 55% of all subscriptions received for

that midweek draw; and

(b) for a super 66 draw, 56.5% of all subscriptions received for

that super 66 draw;

"receipted ticket" means a ticket that is produced and issued by an agent either as a result of processing an entry coupon, or as a response to an oral request by a subscriber;

"Saturday" means Saturday evening;

"sellin period" means the period of time terminating a t 5.00 p.m. on

4.00 p.m. on that day, if so determined by the Commission horn

"super 66 drawn means a draw described in Part 6 of the Lotteries

Commission (Saturday Lotto) Rules 1995 that may be entered as
a supplement to midweek lotto;

"supplement number" in relation to a midweek lotto draw, means
one of the ast 2 numbers drawn; "r
Yotal prize pool" means the prize pool for that draw, plus any jackpot amount from a previous draw and any amount from the prize
reserve fund that has been taken from the fund to ensure that a
guaranteed minimum prize pool for the draw is met;

"winning number" means -

(a) in relation to a midweek lottx, draw, any one of the first 6

numbers drawn in that draw;

(b)

in relation to a super 66 draw, the number made up by the 6 digits drawn in any one super 66 draw, in the order drawn.

PART 2 - IUEQURXEMENTS FOR ENTRY

Entry coupon

4.    (1) The Commission must ensure that an entry coupon for midweek

lotto -

displays such details to facilitate entry as the Commission thinks

(a) necessary; and

displays any instructions which the Commission may from time to

(b) time approve.
(2) An entry coupon ma be rejected by the agent as an invalid entry, a t
the time of presentation by d e subscriber, if -
(a) it has not been marked by hand in blue ball point pen in

accordance with the conditions on that entry coupon; or

(b) it has been generated or marked by mechanical or electrical

means.

Methods of entry

5. (1) A person may enter midweek lotto using any or all of the following

methods -

(a) by filling out an entry coupon so as to select between 4 and 20
numbers from the numbers 1 to 45;
(b) b i oral request for a selection of between 4 and 20 numbers from

t e numbers 1 to 45,

and by paying the appropriate amount set out in Schedule 1.
(2) A midweek lotto entry must be specified to be -
(a) for 1 week or for 2 ,5 or 10 consecutive weeks; and
) with or without a supplementary entry or entries in a super 66
draw or draws.

Super 66 entry

6. (1) A person wishing to enter a super 66 draw in con-unction .with a
midweek lotto e n t y ma only do so when the minimum num er of midweek L
lotto games set out m m e 8 are also being entered. T
(2) Subject to subrule (11, a subscriber may enter either one, 2, 4, 8, or
entry - 10 super 66 games in a super 66 draw, in conjunction with a midweek lotto
(a) by marking the entry coupon in the appropriate box; or
(b)
by makin an oral request for the number of super 66 games to

be entere f in that draw,

and paying $1.00 per super 66 game entered.

Super 66 receipted ticket

7. (1) Where a super 66 draw or draws are entered in conjunction with a

midweek lotto entry, a separate receipted ticket must be generated for the
super 66 games entered.

Each su er 66 receipted ticket will have a random selection of 6 su scriber's selected digits or that draw.

Completion of entry coupon

8.      (1) To enter midweek lotto using an entry coupon, a subscriber

must -

(a) select 6 numbers out of the numbers 1 to 45 for each of a t least 2

ames on the entry coupon commencing with the game marked

the numbers 1 to 45 in one or more games on the entry coupon, select between 4 and 20 numbers (other than 6 numbers) out of

commencing with the game marked "1 .

(a) that the entry is for midweek lotto;
(b) where applicable, how many super 66 games are to be entered using that entry coupon;
(C) how many, if any, consecutive weeks the entry coupon is ta be

entered; and

(d) whether the method of entry is a "systems" entry, being either a

systems 4-5 or a systems 7-20, depending on the number of

numbers selected in each game,

and must pay the amount calculated in accordance with Schedule 1 and $1.00
per super 66 game entered.

(3) Where between 4 and 20 numbers (other than 6 numbers) are selected out of the numbers 1 to 45 in the game marked "1" -

(a) if 4, 5, 7, or 8 numbers are selected, then up t o 11 further games

may be marked by selecting the same number of numbers as were

selected in the game marked "1"; or

if between 9 and 20 numbers are selected then up to 4 further

(b) games ma be marked by selecting the same number of numbers
as were se 7 ected in the game marked "1".

9. (1) To enter midweek lotto without an entry coupon, a subscriber must make an oral request at the selling oint and a receipted ticket or tickets

must be produced in accordance with t e subscriber's instructions. R
(2) A subscriber's oral request must state -
(a) whether the subscriber wishes to select -
(i) 6 numbers out of the numbers 1 to 45 -in

which case the

single receipted ticket will be entered for 12 games; or

(ii)     between 4 and 20 numbers (other than 6) out of the

numbers 1 to 45 - in which case the single receipted ticket
will be entered for one game;
(b) that the entry is for midweek lotto;
(C) the week, or number of consecutive weeks, the entry is to be
entered;
(d) whether the entry is to include a su er 66 game and, if so, how
many, with a limit of 10 per receipte B ticket.
(3) A receipted ticket or tickets must be ven to the subscriber upon
payment of the amount calculated in accor ance with Schedule 1 and f

payment of $1.00 per super 66 game entered.

No limit to number of entries

10. A subscriber is not limited in the number of entries which may be made in midweek lotto or in any super 66 draw.

Accuracy of receipted ticket

11.   (1) An agent who -

(a) processes an entry coupon, resulting in a receipted ticket; or
(b) produces a receipted ticket as a result of an oral request,
is under no duty to ensure that the e n t ~ coupon or request is accurately

processed or reproduced on the receipted tic et.

(2) Where a receipted ticket is produced which -
(a) is not an accurate reproduction of the details on the entry coupon

used to generate the ticket; or

03)      does not accurately reflect the oral request for an entry,

the subscriber may return the receipted ticket -

(c) to the selling point at which it was purchased;
(d) on the day on which it was purchased;
(e) prior to the close of the day's lotto business for that selling point;

and

(0 within the selling period for that ticket.
may surrender that receipted ticket in exchange for - (3) Upon returning the receipted ticket under subrule (2) the subscriber
(a) a full refund of the subscription; or
(b) a further receipted ticket.

Validity of receipted ticket

12.     A receipted ticket is an acknowledgement by the Commission that it

has accepted that entry, as a pearing on the ticket in midweek lotto for the

numbered super 66 draw or draws unless - numbered midweek draw(s) s own on the ticket and, where applicable, in the E
(a) that receipted ticket has been returned or surrendered in accordance with rule 11 (2) or rule 13;
(b)
that recei ted ticket has been found to be invalid, as a result of
non-compgance with rule 4 (23, during the selling period prior to

the relevant midweek lotto draw; or

(C) the recei ted ticket is forged, altered or obtained as a direct result of R aud by the subscriber or person claiming a prize.

Surrender of receipted ticket

13. The holder of a receipted ticket may surrender that ticket, whether under the provisions of rule 11 (2) or for any other reason -

(a) to the selling point at which it was purchased;
(b) on the day on which it was purchased;

prior to the close of the day's lotto business for that selling point;

(c) and
(d) within the selling period for that ticket,

and if the subscriber does so the subscriber is entitled to a full refund or a

further receipted ticket in exc&ange for the surrendered ticket.

En t ry by mail

14. (1) Subject to subrule (2), the Commission must produce a recei

ticket where an entry coupon is delivered b mad and completecl' m

accordance with these rules, and accompanied by & e correct payment.

(2) Where ayment is tendered by cheque with an entry coupon delivered by maf; the Commission is under no duty to issue the receipted ticket until after that cheque has been cleared.

ames) is insufficient to enable the requested number of games to be entered, %e Commission may enter the maximum number of games that could be entered using the money tendered, and refund any balance to the subscriber.

If an entry coupon is received by the Commission by mail, together selected numbers, t e Commission ma E ignore the highest additional number

or numbers when producing a receipte cf ticket from that entry coupon.
(5) If an entry coupon is received by the Commission b mail, together
with correct payment, and that coupon is bent or creased to t e extent that a K computer terminal will not accept or correctly read the coupon, the
Commission ma roduce a receipted ticket that reflects the Commission's
determination o t e subscribers intentions as shown by the coupon and the Y g
subscriber is bound by any such determination.
If a request for a receipted ticket is received by the Commission by mail, together with correct payment, and a cou on is not enclosed, the Commission may produce a receipted ticket that re ects the request and the P1 subscriber is bound by the Commission's production of that receipted ticket.

(6)

If an entry coupon is received by the Commission by mail, together with the correct payment, and that coupon is specified as being -

(a) a single week entry for a numbered midweek lotto draw; or
(b) a multiweek entry commencing with a numbered midweek lotto

draw,

the Commission must enter the subscriber in that midweek lotto draw, or

sequence of draws, unless -

(C)

the sellin period for that single numbered midweek lotto draw has passe$ in which Ease the receipted ticket will be issued for the next mdweek lotto draw;

(d) has passe% in which case the receipted ticket will be issued for a
the sellin period for that initial numbered midweek lotto draw
sequence o ! draws commencing with the next midweek lotto draw.
(8) A recei ted ticket under this rule must be posted by the Commjssion

(9) The Commission is not responsible for the security or loss of a

receipted ticket after it has been posted.

PART 3 - GENERAL DUTIES OF COMMISSION

Midweek draws to be numbered

15. (1) Each midweek lotto draw that is conducted by the Commission is

to be identified with a "draw number".

A super 66 draw has the same number as the Saturday lotto draw that takes place on the Saturday that the super 66 draw takes place.

Lotto to be supervised

16. Midweek lotto is to be supervised in a manner specified by the

Commission.

Publication of results

17.      Each time midweek lotto is conducted the Commission must publish -

(a) the identifying "draw number" for that midweek lotto draw;
(b) all winning and supplementary numbers;
(C) the prize pool for each division;
(d) the amount allocated per winning entry in each division; and
(e) the claim

Criteria fo r midweek lot to prizes

18.      In a midweek lotto draw the holder of a receipted ticket wins -

(a) division 1, if 6 winning numbers are selected in any one game;
(b) division 2, if any 5 of the 6 winnin numbers and either one of
the 2 supplementary numbers are se ected in the one game; f
(C) division 3, if any 5 of the 6 winning numbers are selected in the
one game;
(d) division 4 if any 4 of the 6 winning numbers are selected in the
one game; and
(e) 2 supplementary numbers are selected in the one game.

Distribution of lot to prize pool

20. (1) The Commission must distribute the lotto prize pool for a
midweek lotto draw as follows -

(a) division 1 - 26.5% of the prize pool;
(b) division 2 - 7.5% of the prize pool;
(C) division 3 - 13.5% of the prize pool;
(d) division 4 - 23.5% of the prize pool; and
(e) division 5 - 29.0% of the prize pool.

The prize pool in a division will be distributed by allocating the prize money in equal shares to each winning game in that division.

(2)

(3) The Commission may round off the individual entitlement for a prize
multiple. in any division (other than &vision 1) to the nearest sum containing a 5 cent

(2) Where there is no midweek lotto division 1 prize winner for 5 consecutive midweek draws, the Commission must allocate the accumulated division 1 prize pool in the 5th midweek lotto draw to the prize pool for the division 2 winners in that midweek lotto draw.

(3) If a midweek lotto division 1 rize pool is distributed to division 2
winners, the rize money is still treate B as a division 1 prize for the purposes

23. (1) The Commission may add part or all of the rize reserve fund to a
midweek lotto division 1 prize pool in a midweek lotto 2 raw.
(2) The Commission may from time to time fix a minimum guaranteed
prize pool for division 1 in a midweek lotto 'Bonus" draw.

26. Subject to rule 32, the Commission may refuse to pay any midweek lotto division 1 prize entitlement to the holder of a receipted ticket that has won a division 1 prize in midweek lotto if the recei ted ticket has not been presented a t the Commission's head office within tl?e relevant claim period under these rules.

30.      The Commission may require the holder of a receipted ticket to

complete a statutory declaration, upon the payment of any midweek lotto

rize to that person, stating that the erson has not, or is not to that person's

Act or these rules in relation to a receipted ticket.

Publication of names and addresses of prize winners

31. The Commission ma ublish the name and address of any prize

Player Registration Service

32. (1) A subscriber may, a t any selling point, request a "Player Registration Service" (PRS) number, which may be used to identify a receipted ticket a s being held by the subscriber.

(2) In the event of any inconsistency arisin between the instruc~ions on
an entry coupon or receipted ticket and these ru es, these rules prevad to the f
