LOTTERIES AND ART UNIONS (AMENDMENT)

ACT.

Act No. 48, 1975.

An Act to enable the maximum value of prizes awarded in certain lotteries and games of chance to be fixed by regulation; for this and other purposes to amend the Lotteries and Art Unions Act 1901-1929, as subsequently amended; and for purposes connected therewith. [Assented to, 7th October, 1975.] BE

Council and Legislative Assembly of New South Wales in	BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative
Parliament assembled, and by the authority of the same, as
follows:—

1. This Act may be cited as the "Lotteries and Art

Unions (Amendment) Act, 1975".

2.      (1) This section and section 1 shall commence on the

date of assent to this Act.

(2) Except as provided in subsection (1), this Act shall commence on such day as may be appointed by the Governor in respect thereof and as may be notified by proclamation published in the Gazette.

3. The Lotteries and Art Unions Act 1901-1929, as

subsequently amended, is amended—

(a) by omitting from section 1 the matter "1901-1929" and by inserting instead the matter ", 1901";

(b)	by omitting section 4 (3) (a) and by inserting instead the following paragraph :—
(a) that the value of the goods, wares or merchandise sold by means of any one lottery shall not exceed the prescribed amount;

(c)

(c)	by omitting from section 4A (3) (b) the words "two hundred dollars" and by inserting instead the words "the prescribed amount";
(d)	by inserting after section 23 (1) the following subsection :—

(1A) Regulations may be made so as to apply

differently according to such factors as may be
specified in the regulations.

4. Each provision of the Lotteries and Art Unions Act 1901-1929, as subsequently amended, specified in Column 1 of the Schedule is amended in the manner set forth opposite that provision in Column 2 of the Schedule.

(3) Section 41 of the Interpretation Act, 1897, applies in respect of a regulation made under this Act as if this Act had been passed after the commencement of the Interpretation (Amendment) Act, 1969.
