s1 3 s5 Lotteries Amendment Rule (No. 2) 2007 No. 134, 2007 1 Short title This rule may be cited as the Lotteries Amendment Rule (No. 2) 2007 . 2 Commencement This rule commences on the day the Lotteries Amendment Act2007 commences. 3 Rule amended This rule amends the Lotteries Rule 1998. 4 Amendment of s 33 (Bonus prize reserve) Section 33— insert— ‘(3) The lottery operator must identify the bonus prize reserve in the lottery operator’s accounting records as a bonus prize reserve until it is dealt with under subsection (1) or (2).’. 5 Insertion of new s 33A After section 33— insert— ‘33A Payment of bonus prize reserve into the consolidated fund ‘(1) This section applies if a person stops being a lottery operator. ‘(2) The person must pay to the chief executive the amount of a bonus prize reserve that has not been distributed under section 33. ‘(3) Subsection (2) does not apply to the bonus prize reserve for a local lottery conducted as part of a scheme mentioned in section 34. ‘(4) The chief executive must pay the amount received under subsection (2) into the consolidated fund.’.

s6 4 s9 Lotteries Amendment Rule (No. 2) 2007 No. 134, 2007 6 Amendment of s 35 (Jackpot and bonus prize reserve funds to be division 1 prize) Section 35— insert— ‘(3) The lottery operator must identify the jackpot prize pool in the lottery operator’s accounting records as a jackpot prize pool until it is distributed in a drawing of the lottery.’. 7 Insertion of new s 35AA Part 7— insert— ‘35AA Payment of jackpot prize pool into the consolidated fund ‘(1) This section applies if a person stops being a lottery operator. ‘(2) The person must pay to the chief executive the amount of a jackpot prize pool that has not been distributed in a drawing of a lottery. ‘(3) The chief executive must pay the amount received under subsection (2) into the consolidated fund.’. 8 Insertion of new pt 9, div 1, hdg Part 9, before section 41— insert— ‘Division 1 Repeal and transitional provisions for Lotteries Rule 1998’. 9 Insertion of new pt 9, div 2 Part 9— insert— ‘Division 2 Transitional provisions for Lotteries Amendment Rule (No. 2) 2007

s9 5 s9 Lotteries Amendment Rule (No. 2) 2007 No. 134, 2007 ‘43 Definition for div 2 ‘In this division— commencement means the commencement of the provision in which the term appears. ‘44 Registration of players and lottery agents ‘A register kept under part 2 by GCLC as a lottery licensee immediately before the commencement continues in existence as a register kept by GCLC as a lottery operator. ‘45 Player accounts ‘A player account held under part 3 by GCLC as a lottery licensee immediately before the commencement continues to be held by GCLC as a lottery operator. ‘46 Syndicates ‘A syndicate formed under part 3A by GCLC as a lottery licensee and in existence immediately before the commencement continues in existence as a syndicate formed by GCLC as a lottery operator. ‘47 Applications and requests ‘An application or request under this rule, received but not dealt with by GCLC immediately before the commencement, must be dealt with by GCLC as a lottery operator. ‘48 Things taken to have been done by, or in relation to, GCLC as a lottery operator ‘For the application of this rule from the commencement, anything done before the commencement by, or in relation to, GCLC as a lottery licensee is taken to have been done by, or in relation to, GCLC as a lottery operator.’.
