Lotteries (Amendment) Act 1994

An Act to amend the Lotteries Act 1964

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Lotteries (Amendment) Act 1994.

Commencement

2.  This Act commences on the day on which it is notified in the Gazette.

Principal Act

3.  In this Act, “Principal Act” means the Lotteries Act 1964.1

Insertion

4.  After section 12 of the Principal Act the following section is inserted:

Instant lotteries

“12A.  (1)  Where there appears on a ticket in an instant lottery—

(a)the expression ‘match 3’, ‘match three’, ‘match any 3’ or ‘match any three’; or

(b)an expression to a similar effect;

the expression shall be taken to have always had the same meaning as the expression ‘find 3 of the same’.

“(2)  In this section—

‘instant lottery’ means an approved lottery in which prizes are determined (wholly or partly) by exposing the matter in panels on the tickets in the lottery.”.

Application

5.  The Principal Act as amended by this Act applies in relation to tickets in instant lotteries whether purchased before or after the commencement of this Act other than any ticket in relation to which proceedings in a court have been instituted before 4 August 1993.

Further amendments

6.  The Principal Act is further amended as set out in the Schedule.

Subsection 3 (3)—

Omit “the last two preceding subsections”, substitute “subsections (1) and (2)”.

Subsection 4 (1) (definition of “approved lottery”)—

Omit “seven of this Act”, substitute “7”.

Subsection 6 (2)—

Omit “the last preceding subsection”, substitute “subsection (1)”.

Paragraph 6 (2) (d)—

Insert “or her” after “his” (wherever occurring).

Subsection 7 (2)—

Insert “or her” after “his”.

Subsection 7 (4)—

Insert “or she” after “he”.

Subsection 8 (2)—

Omit “the last preceding section”, substitute “section 7”.

Section 8 (penalty provision at foot)—

Omit the penalty provision, substitute the following penalty provision:

“Penalty:  $200.”.

Section 9 (penalty provision)—

Omit the penalty provision, substitute the following penalty provision:

“Penalty:  $100.”.

Paragraph 12 (b)—

Insert “, she” after “he”.

Section 12 (penalty provision)—

Omit the penalty provision, substitute the following penalty provision:

“Penalty:  $200.”.

Subsections 13 (2) and (3)—

Insert “or her” after “him”.

Subsection 13 (4) (penalty provision at foot)—

Omit the penalty provision, substitute the following penalty provision:

“Penalty:  $100.”.

Section 14 (penalty provision)—

Omit “five”, substitute “5”.

Section 15—

Insert “or her” after “his”.

Section 15 (penalty provision)—

Omit the penalty provision, substitute the following penalty provision:

“Penalty:  $1,000.”.

Section 16 (penalty provision)—

Omit the penalty provision, substitute the following penalty provision:

“Penalty:  $200.”.

Section 17—

Omit “three”, substitute “3”.

Subsection 18 (1)—

Insert “or her” after “his”.

Subsection 18 (2)—

Omit “the last preceding subsection”, substitute “subsection (1)”.

Paragraph 18 (2) (b)—

Insert “or she” after “he”.

Paragraph 18 (3) (a)—

Insert “or her” after “his”.

Paragraph 18 (3) (b)—

Omit “under the last preceding subsection”, substitute “or her under subsection (2)”.

Section 18 (penalty provision at foot)—

Omit the penalty provision, substitute the following penalty provision:

“Penalty:  $100.”.

Subsection 19 (1)—

Insert “or her” after “his” (wherever occurring).
