10210 SCROOIS OF ARTS. Longreach School of Arts Land Sale Act. 1 Gm. V., the following order, so far as the same shall extend, that is to say, in payment of— (i.) The reasonable expenses of and attending such mortgage; (ii.) The costs of applying for, obtaining, and passing this Act; (iii.) The cost of the enlargement and improvement of the said School of Arts buildings on the said. lands; (iv.) The. cost of the necessary furniture, fittings, and equipment of the said buildings. Trustees' 6. The receipts in writing of the Trustees exercising receipts to be any of the powers conferred by this Act for any moneys da,isgcohoadrge. paid or advanced to them in respect of any mortgage given in pursuance of the powers aforesaid shall be a good and sufficient discharge for such moneys to the person or persons paying or advancing the same, and he or they shall not be bound or required to see to the application, nor be affected by the misapplication or non-application thereof. • 1 Geo. Sell the Same or any part thereof, together with the Buildings erected thereon, and. to Devote the Proceeds to the Purchase of Another Site and to the Building thereon of a New and More Commodious School of Arts. W HEREAS Henry Ellis, John Cameron, David Cannon, Howard English,. and James Peter Peterson are the registered proprietors in fee-simple, under "The Beal Properly Acts, 1861 to 1887," of certain parcels of land situated in the town of Longreach, parish of Longreach, county of Portland, being allotments one and two of section seven, containing two roods sixteen perches, and which are more particularly described in Deed. of Grant Number C5253, Volume 91, Folio 209, Central Registry, upon trust for a School of Arts: *25 Vic. And whereas the said Trustees have for many years used the said lands for the purposes of the Longreach School of Arts: And whereas the said Trustees are desirous of selling the said lands, together with the buildings erected thereon, and of devoting the proceeds arising from such sale to the , purchase of another site and the building thereon of a new and more comModious School of Arts and the furnishing and due equipment of the same : • And whereas it is expedient that such powers should be granted to the said Trustees subject to the conditions hereinafter mentioned: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of Queens- land in Parliament assembled, and by the authority of the same, as follows :- 1. This Act may be cited as " The Longreach School Short title. of Arts Land Sale Act of 1910." 2. In this Act the expression "the Trustees" means naterpreta- and includes the said Henry Ellis, John Cameron, David ti". Cannon, Howard English, and James Peter Peterson and their successors. 3. The Trustees, at any time after the passing of this Power to sell. Act, may sell the said parcels of land, or such part thereof as the Trustees may consider advisable, together with the buildings erected thereon, by public auction or private contract or both such modes of sale, and either for cash or on credit, or partly for cash and partly on credit; and on payment of the purchase money into the hands of the Trustees they shall transfer the land so sold to the purchaser, and such transfer shall be valid and effectual for all purposes. In the case of a sale by auction the Trustees shall give due notice thereof, by advertisement in a newspaper published at Longreach aforesaid, at least fourteen days before the datesof such sale; and the Trustees .may insert any special or other stipulations in any conditions of sale n as they think fit. d The Trustees may also buy in such lands or any part l thereof at any sale by auction, and may rescind or vary any contract for sale, and may resell the lands which have . bbeeeennssoorebsocuingdhetdi. n or as to which any such contract has

Upon receipt of the money realised by such sale, of proceeds. the Trustees shall, in the first place, pay the reasonable expenses of such sale and the costs, charges, and expenses of and attending the applying for and obtaining and passing of this Act; and shall, in the next place, deposit the remainder of the purchase moneys in the Queensland National Bank, Limited, at Longreach, and shall not withdraw the same or apply any part thereof for any purposes except for the purchase of another parcel of land and for defraying the cost of erecting thereon and furnish- ing and equipping buildings suitable for the purpose of a School of Arts. And the Trustees shall bold the lands and property so to be purchased and acquired upon the trusts declared in the said recited Deed of Grant to all intents and purposes as though the said land had been thereby granted to them. 1 Geo. An Act to Enable the Trustees of the Mackay School THE MACKAY SCHOOL or of Arts to Sell or Mortgage the Land comprised ARTS LAND SALE ACT OF in Deed of Grant No. 1 8060, being Allotment 3 1910. of Section 28, Town of Mackay, and to Apply the Moneys so raised towards the Improvement of .the said Land and for other incidental purposes. [ASSENTED TO 13TH DECEMBER., 1910] Preamble. WHEREAS by a deed of grant dated the fifteenth day of April, one thousand nine hundred and ten, and numbered N8060, all that parcel of land in the State of Queensland, containing two roods, be the same more or less, situated in the county of Carlisle, parish of Howard, town of Mackay, being allotment three of section twenty- eight (hereinafter referred to as the "said land "), and more particularly described in the said deed of grant, was granted to David Hay Dalrymple, Robert Fleming, and William George Hodges, all of Mackay aforesaid, upon trust for a School of Arts, and for nod other purpose whatsoever: And whereas it is expedient that the Trustees should be empowered to sell and dispose of oi mortgage the whole • ar any part of the said allotment, together with the buildings erected thereon, and with Or without any right- of-way to any portion sold, and to use the proceeds of the moneys so raised towards the erection of additions and
