SCHOOLS OF ARTS. 5 GEO. V., 1914. Longreach, School of Arts Act, 459 SCHOOLS OF ARTS. An Act to Ratify and Confirm a certain Agreement 5 Geo. V. between the Council of the Shire of Longreach LONTGHREEACH and the Trustees of the Longreach School of SCHAOROTLSOF Arts, enabling the said Council to Assume the ACT OF 1914. Control and Management of the said School of Arts, and to Erect on a Certain Reserve placed under the Control of the said Council and • to Furnish and Equip a new School of Arts Building, and Authorising the said Trustees to provide Moneys towards the Cost thereof, and for other purposes consequent thereon.- [ASSENTED TO 17T11 DECEMBER, 1914.] W HEREAS an Agreement, dated the thirty-first day Preamble. of July, one thousand nine hundred and fourteen, has been made and entered into by and between the Council of the Shire of Longreach and Henry Ellis, David Cannon, Howar.d English, and James Peter Peterson, the surviving Trustees of the Longreach School of Arts, for the purpose of enabling the said Council to assume the control and management of the said School of Arts, and to erect, on a certain reserve for a public park placed under the control of the said Council, being section fifty - four, in the town and parish of Longreach, containing one rood thirty perches, and furnish and equip, a new •School of Arts building, and authorising'the said Trustees to pay over to the said Council certain moneys, being the proceeds of land sold by the said Trustees pursuant to the powers conferred by "The Longreach School of Arts Land Sale Act of 1910," which moneys are to be applied by the said Council for the aforesaid purpose, and con- taining provisions necessary to give effect to the aforesaid purpose, a copy of which said Agreement is set forth in the Schedule to this Act: And whereas the carrying into full effect of the said Agreement would be to the public advantage, and it is therefore expedient that the said Agreement should be ratified and confirmed by an Act of Parliament: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the *1 Geo. V., Legislative Council and Legislative Assembly of Queens- land in Parliament assembled, and by the authority of the same, as follows :- Short title. 1. This Act may be cited as "The Longreach School of Arts Act of 1914.' Ratification 2. (1.) The Agreement made and entered into on acnodnfirmation the thirty-first day of July, one thousand nine hundred of Agreement and fourteen, by and between the Council of the Shire [Schedule.] of Longreach and Henry Ellis, David Cannon, Howard English, and James Peter Peterson, surviving Trustees of the Longreach School of Arts, a copy whereof is set forth in the Schedule to this Act, is hereby ratified and confirmed, and from and after the passing of this Act shall be of full force and effect. - (2.) Notwithstanding anything contained in "The Longreach School of Arts Land Sale Act of 1910," the said Trustees are hereby authorised to transfer, assign, and make over to the said Council the sum of one thousand five hundred pounds, with any interest accrued thereon, being the proceeds in their hands arising from the sale of land pursuant to the said Act, after payment thereout of the costs of and incidental to the said Agreement and to the preparation and passage of this Act, and all the building, furniture, chattels, and effects mentioned in the said Agreement. (3.) Notwithstanding anything contained in "The Local Authorities Acts, 1902 to 1913,"1- or "The Land Act of 19101 the said Council is hereby authorised to erect on the reserve for a public park, being section fifty-four, in the town and parish of Longreach, and to furnish and equip, a new School of Arts building, and to assume the control and management of the same, and to carry into effect the provisions of the said Agreement; and for these purposes the powers hereby conferred shall be in addition to all other powers and authorities vested in it by the aforesaid Acts and each of them. (4.) Provided that the fact of the management of the said School of Arts by the said Council shall not have any effect in depriving the said School of Arts of the benefit of any share of endowment, which may at any time be appropriated for the purposes of schools of arts by Parliament out of the Consolidated Revenue Fund. *1 Geo. SCHOOLS OF ARTS. 1914. Longreach, School of Arts Act, SCHEDULE. MEMORANDUM OF AGREEMENT made this thirty-first day of July one thousand nine hundred and fourteen between the Council of the Shire of Longreach (hereinafter called "the Council ") of the one part and Henry Ellis David Cannon Howard English and James Peter Peterson (hereinafter called "the Trustees") of the other part WHEREAS the Trustees together with John Cameron late of Brisbane in the State of Queensland deceased are the Trustees mentioned in "The Longreach School of Arts Land Sale Act of 1910 "* AND WHEREAS the said John Cameron died on the twenty-fifth day of June one thousand nine hundred and fourteen AND WHEREAS the Trustees in pursuance of section three of the said Act have sold the land therein referred to to the Bank of New South Wales for the sum of Fifteen Hundred Pounds which amount has been deposited in the Queensland National Bank Limited at Longreach by which bank it is still held in accordance with the provisions of section four of the said Act AND WHEREAS the Trustees have been unable by reason of the scarcity and high price of land in Longreach to obtain the fee-simple of another suitable 'parcel of land for the pinposes of the said Act AND WHEREAS section fifty-four in the town and parish of Longreach contain- ing an area of one rood thirty perches is vested in the Council as trustees under "The Land Act of 1910"f as a reserve for public park AND WHEREAS the'Trustees desire that the Council shall assume the control and management of the Longreach School of Arts and for that purpose propose to hand over the said sum of fifteen hundred pounds to the Council after payment thereout of the costs of these presents and the preparation and passage of the Act of Parliament hereinafter mentioned so that same may be expended in erecting a new School of Arts on the said section fifty-four and completely furnishing and equipping the mine. Now therefore this Agreement witnesseth as follows 1. Subject to the ratification and confirmation of these presents by Act of Parliament the Trustees agree to give and the Council agree to assume and take over the control and management of the Longreach School of Arts. 2. For the purposes of carrying the provisions of the foregoing clause into effect all the building furniture books moneys chattels and effects (incla ding the said sum of fifteen hundred pounds hereinbefore recited) shall be transferred assigned and made over by the Trustees to the Council subject to the payment thereout of all the expenses apper- taining thereto to these presents and to the obtaining of any Act of Parliament Such transfer and assignment to take effect immediately upon the passing of the necessary Act of Parliament ratifying and confirming these presents. 3. The Council shall thereupon with the said sum so paid over by the Trustees and such further sum (if any) as they may decide to add thereto proceed to erect on the said section fifty-four a new School of Arts and properly complete and furnish and equip the same as a reading-room and library and also (if the Council see fit) as a billiard- room and with other provisions and arrangements for the recreation or convenience of the public or of subscribers. 4. The Council may either decide that the future management be vested— (a) In the whole Council or any committee thereof or (b) In an executive composed of elected representatives of subscribers and a specified number of councillors. 6. The By-laws (if any) governing the institution shall be formu- lated by the Council at its discretion. 7. The Trustees shall forthwith promote the necessary Act of Parliament for the ratification and confirmation of these presents and for the amendment of " The Longreach, School of Arts Land Sale Act of 1910."* IN WITNESS WHEREOF the said parties hereto have hereunto set their hands the day and year first herein written.
