An Act to amend the Long Service Leave Act 1976, the Long Service Leave (Building and Construction Industry) Act 1981 and the Long Service Leave (Contract Cleaning Industry) Act 1999

Notified under the Legislation Act 2001 on 2 October 2003

(see Legislative Assembly for the Australian Capital Territory enacts as follows:

Part 1Preliminary

1. Name of Act

   This Act is the Long Service Leave Legislation Amendment Bill 2003.

2. Commencement

   This Act commences on the day after its notification day.

   NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

Part 2Long Service Leave Act 1976

1. Act amended—pt 2

   This part amends the Long Service Leave Act 1976.

2. Section 9

   substitute

3. Public holidays not to count as leave

4. This section applies if a public holiday or an award holiday falls during a period of long service leave taken by an employee.

5. The period of long service leave is increased by 1 day for each such holiday.

6. Pro rata long service leave entitlement
   Section 11C (1) (b)

   omit

   not less than 7 years

   substitute

   at least 5 years

Part 3Long Service Leave (Building and Construction Industry) Act 1981

1. Act amended—pt 3

   This part amends the Long Service Leave (Building and Construction Industry) Act 1981.

2. Section 58

   substitute

3. Public holidays not to count as leave

4. This section applies if a public holiday or an award holiday falls during a period of long service leave taken by a registered employee or a contractor.

5. The period of long service leave is increased by 1 day for each such holiday.

Part 4Long Service Leave (Contract Cleaning Industry) Act 1999

1. Act amended—pt 4

   This part amends the Long Service Leave (Contract Cleaning Industry) Act 1999.

2. Section 59

   substitute

3. Public holidays not to count as leave

4. This section applies if a public holiday or an award holiday falls during a period of long service leave taken by a registered employee.

5. The period of long service leave is increased by 1 day for each such holiday.

6. In this section:

   award holiday means a day that is a holiday for people employed in the contract cleaning industry because of an award or agreement.
