An Act to amend the Long Service Leave (Building and Construction Industry) Act 1981

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Long Service Leave (Building and Construction Industry) (Amendment) Act (No. 2) 1996.

Commencement

2. This Act commences on the day on which it is notified in the Gazette.

Principal Act

3.  In this Act, “Principal Act” means the Long Service Leave (Building and Construction Industry) Act 1981.1

Interpretation

4.  Section 3 of the Principal Act is amended by inserting in subsection (1) the following definition:

“ ‘defined fraction’ means—

(a)in relation to service that occurred before the commencement of the Long Service Leave (Building and Construction Industry) (Amendment) Act (No. 2) 1996—13/15; and

(b)in relation to service that occurred on or after that commencement—13/10;”.

Amount of leave

5.  Section 51 of the Principal Act is amended by omitting from paragraphs (1) (a) and (b) “13/15” and substituting “the defined fraction”.

Entitlement to payment in lieu of leave

6.  Section 53 of the Principal Act is amended by omitting from paragraphs (1) (c) and (d) and (2) (c) and (d) “13/15” and substituting “the defined fraction”.

Payment in lieu of leave on retirement

7.  Section 54 of the Principal Act is amended by omitting from paragraphs (c) and (d) “13/15” and substituting “the defined fraction”.

Amount of payment

8.  Section 57 of the Principal Act is amended by omitting from subsections (1) and (2) “13/15” and substituting “the defined fraction”.
