I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following

Ordinance under the Seat of Government (Administration) Act 1910.

An Ordinance to amend the Long Service Leave Ordinance 1976

Short tide

1. This Ordinance may be cited as the Long Service Leave (Amendment)
Ordinance 1981. 1

Interpretation

defined in that Ordinance; or

2. Section 2 of the Long Service Leave Ordinance 1976 2 is amended—

(a)

by omitting the definition of "employee" in sub-section (1) and substituting the following definition:

" 'employee' includes—

(a) a person who is remunerated at piece-work rates; and

(b) a part-time employee,

but does not include a person who—

(c)

on or after the date fixed by the Minister under sub­ section 2 (2) of the Long Service Leave (Building and Construction Industry) Ordinance 1981, obtains employment for the first time as an employee as defined in that Ordinance with on employer as

(d)

is registered under that Ordinance and who has elected in pursuance of section 63 of that Ordinance to take long service leave benefits under that Ordinance;"; and

(b) by inserting after sub-section (2) the following sub-section:

" ( 2 A ) An employee who—

(a)

is registered under the Long Service Leave (Building and Construction Industry) Ordinance 1981; and

(b)

has elected in pursuance of section 63 of that Ordinance to take long service benefits under this Ordinance in respect of a period specified by the employee,

shall cease to be an employee for the purposes of this Ordinance

when he has received those benefits in respect of that period.".
