Act N o . 185 , 1980 .

An Act to amend the Long Service Leave Act, 1955, to increase penalties for breaches of that Act and to extend the time for recovery of payments under that Act; and for other purposes. [Assented to, 17th December, 1980.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

  1. This Act may be cited as the "Long Service Leave (Amend­

ment) Act, 1980".

2. The Long Service Leave Act, 1955, is referred to in this

Act as the Principal Act.

3.      The Principal Act is amended—

(a) by omitting from section 10 the words "one thousand

dollars" wherever occurring and by inserting instead the

matter "$2,000";

(b)

by omitting from section 12 (1) the words "a period of two years immediately preceding the date of the application." and by inserting instead the words "the period of 6 years immediately preceding the date of the application but not earlier than 2 years before the date of assent to the Long Service Leave (Amendment) Act.

Notwithstanding the operation of section (3) ( a ) , a person who, on or after the date of assent to this Act, is found guilty of an offence committed against the Principal Act before that date, shall not be liable to any greater penalty than that to which he would have been liable if he had been found guilty of the offence immediately before that date.
