Long Service Benefits Portability Amendment Regulations 2021

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Long Service Benefits Portability Regulations 2020 to make changes arising from the enactment of the Industrial Relations Legislation Amendment Act 2021.

2Authorising provision

These Regulations are made under section 79 of the Long Service Benefits Portability Act 2018.

3Principal Regulations

In these Regulations, the Long Service Benefits Portability Regulations 2020[1] are called the Principal Regulations.

4No double-dipping

(1)In regulation 12(2) of the Principal Regulations, after "a fair work instrument" insert ", the Long Service Leave Act 2018 or a contract of employment".

(2)In regulation 12(3) of the Principal Regulations—

(a)after "a fair work instrument" insert ", the Long Service Leave Act 2018 or a contract of employment";

(b)after "the fair work instrument" (where twice occurring) insert ", the Long Service Leave Act 2018 or the contract of employment".

(3)In regulation 12(4) of the Principal Regulations, after "a fair work instrument" insert ", the Long Service Leave Act 2018 or a contract of employment".

(4)In regulation 12(5) of the Principal Regulations—

(a)after "a fair work instrument" insert ", the Long Service Leave Act 2018 or a contract of employment";

(b)after "the fair work instrument" insert ", the Long Service Leave Act 2018 or the contract of employment".
