LOGBOOK NOTICE NO. 15

TORRES STRAIT SPANISH MACKEREL LOG
I, WARREN TRUSS, Minister for Agriculture, Fisheries and Forestry, being satisfied
that information in relation to the taking of certain kinds of fish in Australian waters
is required in pursuit of the objectives of the Torres Strait Fisheries Act 1984, make
the following determination under subregulations 11(1) and 11(2) of the Torres Strait
Fisheries Regulations.

Citation
1.This determination may be cited as Logbook Notice No. 15.
Commencement
2. This determination commences 14 days after the day on which, or the
later of the days on which, this determination is published in the Gazette and in the
Cairns Post newspaper.
Interpretation
3. In this determination:
"area of the Spanish mackerel fishery" means the area described in the Schedule to
this determination;
"dinghy" means a boat which is at most 6 metres in length, other than a tender boat;
"distinguishing mark" in relation to a form of logbook, means the letter, number or
symbol by which the logbook can be distinguished from other forms of logbook;
"primary boat" means a boat which is greater than 6 metres in length and operates in conjunction with a tender boat;
"SM02 Log" means the form of logbook published in March 1990, for which:
(a)the title is "Confidential daily fishing log – Torres Strait Spanish mackerel
logbook"; and
(b)the distinguishing mark is "SM02";
"tender boat" means a boat which is at most 6 metres in length, operates in
conjunction with a primary boat and is licensed to the same person as the primary
boat.
[Note: Terms defined in the Torres Strait Fisheries Act 1984 and terms defined in the Torres Strait
Fisheries Regulations have the same meanings in this determination.]
Which logbooks must be used?
4. If fish of the species Scomberomorus commerson, commonly known as Spanish mackerel, are taken by any method of trolling, handlining or droplining using
a boat other than a dinghy in the area of the Spanish mackerel fishery, the SM02 Log
must be used to record information about the taking of the fish.
When must the logbooks be used?
5.1 Subregulation 12(1) of the Torres Strait Fisheries Regulations applies in respect of the SM02 Log during the period beginning on the commencement of this determination and ending at the end of 1 May 2003.
5.2 Subregulations 12(1) and 12(3) of the Torres Strait Fisheries Regulations
do not apply in relation to the master of a dinghy in respect of the SM02 Log.

6. Copies of the SM02 Log can be obtained during ordinary business hours
from the Australian Fisheries Management Authority at Level 2, Pearls Building,

THE SCHEDULE
AREA OF THE SPANISH MACKEREL FISHERY
The area consisting of:
(a)the area of waters in the Protected Zone to the south of the Fisheries
Jurisdiction Line; and
(b)the area of waters (excluding any waters within the limits of Queensland)
bounded by a line:
(i)commencing at the point of Latitude 10°48'00" South, Longitude
141°20'00" East;
(ii)then running north along the meridian of Longitude 141°20'00" East to
its intersection by the parallel of Latitude 10°28'00" South;
(iii)then east along that parallel to its intersection by the meridian of
Longitude 144°00'00" East;
(iv)then south along that meridian to its intersection by the parallel of
Latitude 10°41'17" South;
(v)then west along that parallel to its intersection by the meridian of
Longitude 142°31'49" East;
(vi)then south along that meridian to its northern-most intersection by the
coastline of Cape York Peninsula at low water;
(vii)then generally south-westerly along the western coastline of Cape
York Peninsula, that is along the low water line on that coast and
across any river moth, to its intersection by the parallel of Latitude
10°48'00" South; and
(viii)then west along that parallel to the point of commencement; and
(c)the territorial sea of Australia north of the Fisheries Jurisdiction Line.
