1. This Ac t may be cited as the " Lockha r t to Clear Hi l l s , via
Boree Creek, Railway Act , 1907 ."
| 2. The car ry ing out t he said work (more par t i cu la r ly | described |
in t he Schedule to this Act) is hereby sanctioned ; and the Secre tary for Pub l i c W o r k s , or t h e M e m b e r of t he Execu t ive Counci l for the t ime being per forming the dut ies of the said Secre tary , is hereby author ised to unde r t ake and carry out the said work, subject to the provisions of this Act , and for t h a t purpose shall be, and shall have t he powers and dut ies of, a Cons t ruc t ing A u t h o r i t y wi th in the
| mean ing of | the Pub l i c W o r k s Act , | 1900. |
3. The p lan of the said work is the p lan marked " L o c k h a r t to
Clear Hi l l s , via Boree Creek, Rai lway," signed by the Secretary for
| P u b l i c W o r k s , and counters igned | by the Chief | Engineer | for | Rai lway |
| and T r a m w a y Construct ion, and deposited in the publ ic office of | t h e |
| said Secretary. |
4 , The cost of car ry ing out the said work, es t imated a t one
hund red and for ty-nine thousand six hund red and e ighty-one pounds shall be defrayed from such Loan Votes as are now or may hereafter bo appl icable to t h a t purpose, or from appropr ia t ions of the P u b l i c W o r k s Fund, or par t ly from such votes and par t ly from the said
appropr ia t ions , and shall not under any c i rcumstances exceed the
| es t imated cost by more t h a n ten per | c e n t u m . |
• 5 . The said l ine of ra i lway may be const ructed on or a long or by t h e side of any publ ic road or h ighway.
6. No tw i th s t and ing the provisions of section e ighty-four of the
Pub l i c W o r k s Act , 1900, t h e Cons t ruc t i ng A u t h o r i t y shal l not be requi red or compelled, nor shall it be t he du ty of the said Author i ty to m a k e or ma in t a in any fence a long the said line of railway for t h e accommodat ion of any person, or for any purpose wha t soeve r ; b u t the said A u t h o r i t y may, in his discretion, m a k e and ma in t a in such fences in connect ion wi th the said line of ra i lway as he may t h i n k fit.
