Regulation 2017

His Excellency the Governor, with the advice of the Executive Council, has made the following
Regulation under the Local Land Services Act 2013.

Explanatory note
The object of this Regulation is to amend the Local Land Services Regulation 2014 to make further
provision in relation to elections for members of local boards, particularly electronic elections.
The Regulation:
| (a) | deals with instructions provided to voters relating to the formality of ballot papers with fewer votes cast than the number of persons to be elected in the election, and |
| (b) | modifies the declaration that an electronic voter must make on the voting website before casting an electronic vote, and |
| (c) | removes the requirement that the voting website must provide a warning message to a voter when |
| the voter is about to cast votes for a number of candidates less than the number of persons to be elected in the election. |
This Regulation is made under the Local Land Services Act 2013, including sections 27 and 206 (the general regulation-making power) and, in particular, section 206 (2) (c) (election of members of local boards).

1 Name of Regulation
This Regulation is the Local Land Services Amendment (Voting) Regulation 2017.
2 Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.

[1] Schedule 1 Elections for members of local boards
Omit clause 23 (2) (b) (i). Insert instead:
(i) how the ballot paper must be completed (including information explaining to the voter that a ballot paper is not informal merely because the number of candidates for whom the voter has recorded a vote is less than the number to be elected in the election), and
[2] Schedule 1, clause 29 (1)
Insert “a document that contains” after “provided with”.
[3] Schedule 1, clause 29 (1) (b)
Omit the paragraph. Insert instead:
(b) the name of the voter as it appears on the roll, and (c) the password required to enable the voter to access the voting website,
[4] Schedule 1, clause 30 (a)
Omit clause 30 (a). Insert instead:
(a) instructions on how to cast a valid vote (including information explaining to the voter that a ballot paper is not informal merely because the number of candidates for whom the voter has recorded a vote is less than the number to be elected in the election), and
[5] Schedule 1, clause 30 (b) (i)
Omit the subparagraph. Insert instead:
(i) that his or her name is the same as the name that is set out in the document that was provided to the voter under clause 29 (being the document containing the voter’s password to enable access to the voting website), and
[6] Schedule 1, clause 34 (2) (b)
Omit the paragraph.
