Local Land Services Amendment

(Miscellaneous) Regulation 2018

Local Land Services Act 2013

His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Local Land Services Act 2013.

Explanatory note

The objects of this Regulation are:

(a) to declare certain species of farmed deer as stock to which Part 9 of the Local Land Services Act 2013 applies, which deals with the transportation of stock by vehicle, and
(b) to make consequential amendments on the commencement of Schedule 1 to the Local Land Services

Amendment Act 2017 with respect to the control of nuisance animals by Local Land Services at the

request of the owner of the land.

This Regulation is made under the Local Land Services Act 2013, including sections 118 (definition of
stock) and 206 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Local Land Services Amendment (Miscellaneous) Regulation
2018.

2      Commencement

This Regulation commences on 1 July 2018 and is required to be published on the
NSW legislation website.

3 Amendment of Local Land Services Regulation 2014

(1) Clause 82 Stock

Insert after clause 82 (h):

(i)      farmed deer of the following species:

(i) Axis axis (commonly known as Chital Deer),
(ii) Axis porcinus (commonly known as Hog Deer),
(iii) Cervus elaphus (commonly known as Red Deer),
(iv) Dama dama (commonly known as Fallow Deer),
(v) Rusa timorensis (commonly known as Rusa Deer),
(vi) Rusa unicolor (commonly known as Sambar Deer).
(2) Clause 100 Nuisance animals
Omit “(other than a pest within the meaning of Part 10 of the Act)”.
(3) Clause 100
Insert at the end of the clause:

Note. Mandatory measures under the Biosecurity Act 2015 may apply with respect to the control of certain nuisance animals.
