1078 Local Government (Validation of Application for Redland Shire Town Planning Scheme) Act 1987, No. 82 WHEREAS the Council of the Shire of Redland has made application to the Minister for the approval by the Governor in Council of a town planning scheme and has failed, before doing so, to publish an advertisement in a newspaper that gives the public notice defined in provisions (i) to (iv) (both inclusive) of paragraph (a) of section 33 (3) of the Local Government Act 1936-1987- And whereas it is desired that the application be treated as a valid application: NOW THEREFORE BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title. This Act may be cited as the Local Government (Validation of Application for Redland Shire Town Planning Scheme) Act 1987. 2. Interpretation. This Act shall be read as one with the Local Government Act 1936-1987. 3. Validation. In respect of the application received by the Minister before the commencement of this Act for the approval by the Governor in Council of a town planning scheme for the Shire of Redland, notice of which application appears published in the Gazette on the 13th December, 1986, it is hereby declared that- (a) for all purposes it shall be deemed that the provisions of paragraph (a) of section 33 (3) of the Local Government Act 1936-1987 requiring a Local Authority, by advertisement published in a newspaper, to give public notice of the matters defined in provisions (i) to (iv) (both inclusive) of the paragraph, have been complied with in all respects; and (b) notwithstanding that a copy of an advertisement published in a newspaper in accordance with paragraph (a) of section 33 (3) of the Local Government Act 1936-1987 did not accompany the application, it shall be competent to the Governor in Council, upon a consideration of the application and all objections and representations that accompanied it, to exercise the powers conferred upon the Governor in Council by paragraph (e) of section 33 (3) of that Act in respect of applications duly made to the Minister under section 33 (3) of that Act.
