Local Government Superannuation Act Amendment Act 1987, No. 81 1075 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short Title . This Act may be cited as the Local Government Superannuation Act Amendment Act 1987. 2. Commencement. (1) Section 1 and this section shall commence on the day this Act is assented to for and on behalf of Her Majesty. (2) Except as provided by subsection (1), the provisions of this Act shall commence on a date to be appointed by Proclamation. The date so appointed is in this Act referred to as the commencement of this Act. 3. Citation. (1) In this Act the Local Government SuperannuationAct 1985 is referred to as the Principal Act. (2) The Principal Act as amended by this Act may be cited as the Local Government Superannuation Act 1985-1987. 4. Repeal of and new s. 16. (1) The Principal Act is amended by repealing section 16 and substituting the following section:- "16. Membership of Board. (1) The Board shall consist of five members as follows:- (a) one person who shall be nominated by the Minister and who shall be the chairman of the Board; (b) two persons who shall be nominated by the Minister after consultation with the Local Government Association of Queensland (Incorporated) and who shall be appointed to the Board as representatives of Local Authorities; and (c) two contributors to the Scheme who shall be nominated by the Minister after consultation with such associations concerned with the interests of permanent employees as he considers appropriate and who shall be appointed to the Board as representatives of the permanent employees. (2) Each member of the Board shall be appointed by the Governor in Council, by notification published in the Gazette, for such period as is specified in the notification.". (2) Upon the commencement of this Act the appointment of each person holding office as a member of the Board immediately before the commencement of this Act shall terminate and he shall go out of office as a member of the Board.
1076 Local Government Superannuation Act Amendment Act 1987, No. 81 5. Amendment of s. 17. Commencement and termination of appointment to Board . Section 17 of the Principal Act is amended in subsection (2) by- (a) re-designating paragraph (f) as paragraph (g); and (b) inserting after paragraph (e) the following paragraph:- "()) being a person appointed as a representative of the permanent employees, he ceases to be a contributor to the Scheme;". 6. Repeal of and new s. 19. The Principal Act is amended by repealing section 19 and substituting the following section:- "19. Casual vacancies . Where a casual vacancy occurs in the office of a member of the Board the vacancy shall be filled, by the appointment as prescribed by section 16 (2), of a person who shall be nominated by the Minister in accordance with that provision of section 16 (1) appropriate to the nomination of the predecessor in office. A person appointed to the Board pursuant to this subsection shall be appointed for such period as is specified in the notification of his appointment published in the Gazette.". 7. Amendment of s. 23. Meetings of Board. Section 23 of the Principal Act is amended in subsection (2) by omitting the first paragraph and substituting the following paragraph:- "A quorum at any meeting of the Board shall consist of four of whom at least three shall be members of the Board and the other may be a deputy for a member of the Board.".
