An Act to repeal certain provisions made by and under the Local Government Act 1919 relating to the erection of residential flat buildings. [Assented to, 4 December 1986]

Local Government (Residential Flat Buildings) Amendment 1986

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:

Short title

1. This Act may be cited as the "Local Government (Residential Flat

Buildings) Amendment Act 1986".

Commencement

2. (1) Sections 1 and 2 shall commence on the date of assent to this

Act.

(2) Except as provided by subsection (1), this Act shall commence on such day as may be appointed by the Governor and notified by proclamation published in the Gazette.

Principal Act

3. The Local Government Act 1919 is referred to in this Act as the

Principal Act.

Amendment of Act No. 41, 1919

4.      The Principal Act is amended in the manner set forth in Schedule 1.

Repeal of certain instruments

5.    The following instruments are repealed:

(a) proclamations under section 309 of the Principal Act which, at any time before the day appointed and notified pursuant to section 2 (2), have not been repealed;

(b)	proclamations under section 314A of the Principal Act which, at any time before that day, have not been repealed;
(c)	ordinances under section 342u (2) of the Principal Act which, at any time before that day, have not been repealed;

(d) Ordinance No. 21 under the Principal Act.

(Sec. 4)

AMENDMENTS TO THE PRINCIPAL ACT

(1) Section 304 (Interpretation)—

Section 304. definitions of "Flat", "Residential flat building",

"Storey"—

Omit the definitions.

(2) Part XI. Division 3 (Residential districts)—

Omit the Division.

(3) Section 314 (Duty of council)—

(a)	Section 314(1) (b)— Omit "instrument; and", insert instead "instrument.".
(b)	Section 314(1) (c)— Omit the paragraph.

(c) Section 314 ( 1 A ) —

Omit the subsection.

(4) Schedule 7 (Classes of residential flat buildings)—

Omit the Schedule.
