An Act to amend the Local Government Act, 1919, in relation to the

purchase of goods by councils. [Assented to, 31st December, 1983.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

Short title.

1. This Act may be cited as the "Local Government (Purchases)

Amendment Act, 1983".

Commencement.

2. (1) Except as provided by subsection (2), this Act shall commence

on the date of assent to this Act.

(2) Section 3 shall commence on such day as may be appointed by the Governor in respect thereof and as may be notified by proclamation published in the Gazette.

Amendment of Act No. 41, 1919.

3. The Local Government Act, 1919, is amended by omitting section

517A and by inserting instead the following section:—

Preference to Commonwealth goods.

517A. (1) In this section—

"Commonwealth goods" means goods manufactured or produced in the

Commonwealth;

"foreign goods" means goods manufactured or produced in any place

outside the Commonwealth;

"goods" includes machinery and materials.

(2) The council, when purchasing or obtaining any goods, shall give a rate of preference of such percentage as may be prescribed to Commonwealth goods over foreign goods.

(3) Nothing in subsection (2) requires the council to give the rate of preference referred to in that subsection to Commonwealth goods over foreign goods where Commonwealth goods of a quality suitable for the purpose cannot be purchased or obtained or Commonwealth goods cannot be purchased or obtained within a reasonable time or in sufficient quantities.
