Act N o . 157, 1980.

An Act to repeal the provisions of the Local Government Act, 1919, relating to public vehicles consequent on the enact­ ment of the State Transport (Co-ordination) Amendment Act, 1980. [Assented to, 11th December, 1980.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1.      This Act may be cited as the "Local Government (Public

Vehicles) Amendment Act, 1980".

2 .       (1) This section and section 1 shall commence on the

date of assent to this Act.

(2) Except as provided in subsection ( 1 ) , this Act shall
commence on the day appointed and notified under section 2 (2)
of the State Transport (Co-ordination) Amendment Act, 1980.

3 .       The Local Government Act, 1919, is amended—

(a)

by omitting the definition of "Public vehicle" in section 4;

(b) by omitting section 507;

(c) by omitting section 513 (1) (m), (ml), (m2) and
( n ) .

(1) A license under the Local Government Act, 1919, in respect of a public vehicle, being a license in force immediately before the day appointed and notified under section 2 (2) of the State Transport (Co-ordination) Amendment Act, 1980—

(a)

shall be deemed to be a license granted under the State Transport (Co-ordination) Act, 1931, as amended by the State Transport (Co-ordination) Amendment Act. 1980; and

(b)

shall continue in force for the unexpired portion of the term for which the license was granted unless sooner surrendered or cancelled under the State Transport (Co-ordination) Act, 1931, as amended by the State Transport (Co-ordination) Amendment Act, 1980.

(2) Where, immediately before the day appointed and notified under section 2 (2) of the State Transport (Co­ ordination) Amendment Act, 1980, there is in force, in relation to a vehicle, a license to which subsection (1) applies and a license granted under the State Transport (Co-ordination) Act, 1931, the license granted under the State Transport (Co­ ordination) Act, 1931, shall, to the extent of any inconsistency between the licenses or between any term, condition or authority contained in, of or attached to the licenses, prevail.
