Local Government (Pastures Protection) Amendment 1985

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:

Short title

1. This Act may be cited as the "Local Government (Pastures

Protection) Amendment Act 1985".

Commencement

(1) Sections 1 and 2 shall commence on the date of assent to this (2) Except as provided by subsection (1), this Act shall commence on the day appointed and notified under section 2 (2) of the Pastures Protection (Rates) Amendment Act 1985 for the commencement of Schedule 1 (3) to that Act.

Amendment of Act No. 41, 1919

3. The Local Government Act 1919 is amended by omitting section 470

(5) and by inserting instead the following subsections:

(5) For the purpose of defraying the expenses incurred by it in

connection with the eradication of noxious plants, a pastures protection	board may make and levy in any year a special rate on each occupier
of land within the district of the board who is liable to pay a general rate within the meaning of the Pastures Protection Act 1934.

(5A) The Governor may by proclamation published in the Gazette

impose a maximum rate under this section.

(5B) The provisions of sections 31-33, 35, 37-39 and 40A of the Pastures Protection Act 1934 apply to a special rate made under subsection (5) in the same way as they apply to a rate made under that Act.

Local Government (Pastures Protection) Amendment 1985

Transitional
Nothing in this Act shall affect the payment, collection or recovery of a special rate made and levied under section 470 of the Local Government Act 1919 by a board within the meaning of the Pastures Protection Act 1934 before the commencement of this Act.
