2 Local Government (Nicholas Street Mall) No. 297, 1993 PART 1—PRELIMINARY ˙ Short title 1. This regulation may be cited as the Local Government (Nicholas Street Mall) Regulation 1993 . ˙ Definitions 2. In this regulation— “ambulance officer” has the meaning given by the Ambulance ServiceAct 1991 ; “Council” means the Ipswich City Council; “fire officer” has the meaning given by the Fire Service Act 1990 ; “mall area” means the part of Nicholas Street, Ipswich— (a) illustrated in Schedule 1; and (b) described in Schedule 2; “police officer” has the meaning given by the Police Service AdministrationAct 1990 ; “trial period” means the period from 6 August 1993 to 31 July 1994. PART 2—PROCLAMATION OF MALL FOR A TRIAL PERIOD ˙ Proclamation of a pedestrian mall under s.35(24B) of the Act 3. The mall area is proclaimed as a pedestrian mall for the trial period.
3 Local Government (Nicholas Street Mall) No. 297, 1993 PART 3—TRAFFIC IN THE MALL ˙ Period of operation of this Part 4. This Part applies only during the trial period. ˙ Vehicles etc. prohibited in mall area 5.(1) A person must not drive or ride a vehicle in the mall area other than as permitted by this regulation. (2) A person must not drive or ride in the mall area a bicycle, tricycle, pair of skates, skateboard or other means of transport. ˙ Exemption for essential services or other purposes 6. Section 5 does not apply to— (a) a police officer, fire officer or ambulance officer acting in the course of the officer’s employment; or (b) a person performing work for the provider, under a State or Commonwealth Act, of a public utility service; or (c) a person acting under section 7; or (d) a person acting in accordance with an exemption granted under section 8. ˙ Service deliveries 7. A person may bring a vehicle into the mall area, between 9 p.m. and 9 a.m., for the purpose of delivering goods or providing services to a business in the mall area or a building adjoining the mall area. ˙ Council may grant exemptions 8.(1) The Council may grant to a person an exemption from the application of section 5 if it considers it reasonable in all the circumstances. (2) The exemption may be granted subject to conditions.

The area is bounded as follows— • start at the southwestern corner of lot 2 on R.P. 204709 • run westerly by a line bearing 274° 46' for a distance of 20.117 m to the southeastern corner of lot 5 on R.P. 47364 • then run northerly along the boundary of lot 5 on R.P. 47364 by a line bearing 4° 56' 15" for a distance of 77.462 m • then run northeasterly by a line bearing 49° 51' 10" for a distance of 4.303 m • then run easterly by a line bearing 94° 46' for a distance of 20.117 m to the northwestern corner of lot 1 on R.P. 204709 • then run southwesterly by a line bearing 229° 53' 10" for a distance of 4.3 m • then run southerly by a line bearing 184° 56' 15" for a distance of 77.462 m to the start. Parish, City, County 2. The land mentioned in clause 1 is in the Parish and City of Ipswich, County of Stanley. Area 3. The mall area is 1619 m 2 .
