s1 2 s6 Local Government (Limited Reviewable Local No. 312, 2002 Government Matters) Amendment Regulation (No. 1) 2002 1 Short title This regulation may be cited as the Local Government (Limited Reviewable Local Government Matters) Amendment Regulation (No. 1) 2002 . 2 Commencement This regulation commences on 1 January 2003. 3 Regulation amended This regulation amends the LocalGovernment(LimitedReviewableLocal Government Matters) Regulation 2002. 4 Amendment of s 3 (Receiving local government) Section 3— insert — ‘(c) for the Boonah/Ipswich relevant area—the Council of the Shire of Boonah; or (d) for the Ipswich/Boonah relevant area—the Council of the City of Ipswich.’. 5 Amendment of s 4 (Transferring local government) Section 4— insert — ‘(c) for the Boonah/Ipswich relevant area—the Council of the City of Ipswich; or (d) for the Ipswich/Boonah relevant area—the Council of the Shire of Boonah.’. 6 Amendment of s 6 (New external boundaries) Section 6—
s7 3 s7 Local Government (Limited Reviewable Local No. 312, 2002 Government Matters) Amendment Regulation (No. 1) 2002 insert — ‘ (5) Map no. LGB66 edition 7 shows the external boundaries of the local government area of the City of Ipswich with the Boonah/Ipswich relevant area excluded. ‘ (6) Map no. LGB17 edition 5 shows— (a) the external boundaries of the local government area of the Shire of Boonah with the Boonah/Ipswich relevant area included; and (b) the internal boundaries of the local government area of the Shire of Boonah with the Boonah/Ipswich relevant area included in division 1 of the local government area. ‘ (7) Map no. LGB17 edition 5 shows the external boundaries of the local government area of the Shire of Boonah with the Ipswich/Boonah relevant area excluded. ‘ (8) Map no. LGB66 edition 7 shows— (a) the external boundaries of the local government area of the City of Ipswich with the Ipswich/Boonah relevant area included; and (b) the internal boundaries of the local government area of the City of Ipswich with the Ipswich/Boonah relevant area included in division 10 of the local government area.’. 7 Amendment of sch (Dictionary) (1) Schedule, definitions “commencing day” and “relevant area”— omit. (2) Schedule— insert— ‘ “Boonah/Ipswich relevant area” means the following areas identified in the Ipswich/Boonah report as part of the local government area of the City of Ipswich— (a) lot 8 on RP 28482; (b) the parts of Willmotts Road, Charles Chauvel Drive, and the unnamed road between lot 10 on RP 28772 and lot 3 on RP 28499, identified in attachment C of the report.
s7 4 s7 Local Government (Limited Reviewable Local No. 312, 2002 Government Matters) Amendment Regulation (No. 1) 2002 “Ipswich/Boonah relevant area” means the following areas identified in the Ipswich/Boonah report as part of the local government area of the Shire of Boonah— (a) lot 2 on RP 187860; (b) lot 102 on Crown Plan CH 3160; (c) the parts of Wilsons Plains Road, Tea Tree Lane, Greenwood Road, and Kalbar-Peak Crossing Road, identified in attachment F of the report; (d) the parts of Limestone Ridges Road and Schossow Road identified in attachment G of the report. “Ipswich/Boonah report” means the report of September 2002 called ‘Local Government Electoral & Boundaries Review Commission— Report on the limited reviewable local government matter affecting Ipswich City/Boonah Shire—Changes to the external boundaries of the area of the City of Ipswich and the area of the Shire of Boonah’. “relevant area” means the following— (a) the Esk/Laidley relevant area; (b) the Laidley/Ipswich relevant area; (c) the Boonah/Ipswich relevant area; (d) the Ipswich/Boonah relevant area. “transfer day” , for a relevant area, means— (a) for the Esk/Laidley and Laidley/Ipswich relevant areas— 8 February 2002; or (b) for the Boonah/Ipswich and Ipswich/Boonah relevant areas— 1 January 2003.’.
5 Local Government (Limited Reviewable Local No. 312, 2002 Government Matters) Amendment Regulation (No. 1) 2002 SCHEDULE MINOR AMENDMENTS section 3 1 Sections 7(1)(b), 8(1), 9(1)(a), 12(2), 13(1) and 16(1) and schedule, definition “existing planning scheme”, ‘commencing day’— omit, insert — ‘transfer day for the relevant area’. 2 Sections 9(1)(b), 11(1)(b), (2), (3) and (5), 14(1)(b), (2) and (4) and 15(1)(b), ‘commencing day’— ‘transfer day’. 3 Sections 10(1), 11(1)(a) and 15(1)(a), ‘commencing day’— omit, insert— ‘transfer day for a relevant area’. 4 Sections 10(1), 11(1)(a) and 15(1)(a), ‘a relevant’— omit, insert — ‘the relevant’. 5 Section 14(1)(a)— omit, insert — ‘(a) was made— (i) under an Act or an existing planning scheme; and
6 Local Government (Limited Reviewable Local No. 312, 2002 Government Matters) Amendment Regulation (No. 1) 2002 SCHEDULE (continued) (ii) to the transferring local government for a relevant area in relation to land in the relevant area; and (iii) before the transfer day for the relevant area; and’.
