s1 3 s3 Local Government Legislation Amendment (No. 3) No. 299, 1996 PART 1—PRELIMINARY ˙ Short title 1. This regulation may be cited as the Local Government Legislation Amendment Regulation (No. 3) 1996 . PART 2—AMENDMENT OF LOCAL GOVERNMENT (ALBERT, BEAUDESERT AND GOLD COAST) REGULATION 1994 ˙ Regulation amended in pt 2 2. This part amends the Local Government (Albert, Beaudesert and GoldCoast) Regulation 1994 . ˙ Amendment of s 8 (City of Gold Coast to have 14 divisions) 3.(1) Section 8(1), ‘edition 2’— omit, insert— ‘edition 3’. (2) Section 8— insert (3) Until the concluding day, the reference in subsection (1) to map no. LGB58 edition 3 is taken to be a reference to map no. LGB58 edition 2, other than for the purposes of the 1997 triennial elections for the mayor and other councillors of the new local government. 1 (4) In subsection (3)— 1 Section 8(1) as previously in force referred to map no. LGB58 edition 2.
s4 4 s4 Local Government Legislation Amendment (No. 3) No. 299, 1996 “concluding day” means the conclusion of the 1997 triennial elections for the mayor and other councillors of the new local government.’. ˙ Replacement of ss 17–18 4. Sections 17 and 18— omit, insert— ˙ 1997 triennial elections 17.(1) The cancellation of the 1997 triennial elections for the mayor and other councillors of the new local government is revoked. 2 (2) Triennial elections for the mayor and other councillors of the new local government are to be held in 1997. 3 ˙ Term of office of councillor 18.(1) The term of office of a person elected as councillor of the new local government at the fresh elections held on 11 March 1995 ends at the conclusion of the triennial elections to be held in 1997. (2) This section is to remove doubt.’. 2 Section 17 as previously in force cancelled the 1997 triennial elections for the new local government. 3 Under section 217(2) of the Act, the 1997 triennial elections are to be held on the last Saturday in March. However, under section 217(3), a regulation may fix a different date for the 1997 triennial elections.
s5 5 s7 Local Government Legislation Amendment (No. 3) No. 299, 1996 PART 3—AMENDMENT OF LOCAL GOVERNMENT (INTERNAL BOUNDARIES REVIEW) REGULATION 1996 ˙ Regulation amended in pt 3 5. This part amends the LocalGovernment(InternalBoundariesReview) Regulation 1996 . ˙ Amendment of s 3 (Definitions) 6.(1) Section 3, definition “commencing day” omit. (2) Section 3— insert— “commencing day” means— (a) for a reviewable local government matter mentioned in section 8A, 8B, 8C, 8D, 16A, 17A, 19A, 19B, 19C, 19D, 19E, 21A, 21B, 22A or 25A—25 October 1996; and (b) for a reviewable local government matter mentioned in part 2, other than in a section mentioned in paragraph (a)—27 September 1996.’. ˙ Insertion of new ss 8A–8D 7. After section 8— insert— ˙ City of Bundaberg 8A.(1) This section implements the reviewable local government matter recommended in the report of the commissioner of October 1996 called
s7 6 s7 Local Government Legislation Amendment (No. 3) No. 299, 1996 ‘Abolition of divisional boundaries – City of Bundaberg’. 4 (2) The divisions of the local government area of the City of Bundaberg are abolished as shown on plan LGB23 edition 2. ˙ Shire of Burnett 8B.(1) This section implements the reviewable local government matter recommended in the report of the commissioner of October 1996 called ‘Abolition of divisional boundaries – Shire of Burnett’. 5 (2) The divisions of the local government area of the Shire of Burnett are abolished as shown on plan LGB59 edition 2. ˙ Shire of Caboolture 8C.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of July 1996 called ‘Review of divisional boundaries – Shire of Caboolture’. 6 (2) The local government area of the Shire of Caboolture is redivided into the 6 divisions shown on plan LGB27 edition 3. (3) The councillors of the Council of the Shire of Caboolture are assigned to the divisions as follows— (a) division 1—1 councillor; (b) division 2—1 councillor; (c) division 3—1 councillor; (d) division 4—1 councillor; 4 The public office of the Council of the City of Bundaberg is located at 188–190 Bourbong Street, Bundaberg. 5 The public office of the Council of the Shire of Burnett is located at 9 Barolin Street, Bundaberg. 6 The public office of the Council of the Shire of Caboolture is located at 2 Hasking Street, Caboolture.
s8 7 s8 Local Government Legislation Amendment (No. 3) No. 299, 1996 (e) division 5—1 councillor; (f) division 6—1 councillor. ˙ City of Caloundra 8D.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of September 1996 called ‘Review of divisional boundaries – City of Caloundra’. 7 (2) The local government area of the City of Caloundra is redivided into the 10 divisions shown on plan LGB30 edition 3. (3) The councillors of the Council of the City of Caloundra are assigned to the divisions as follows— (a) division 1—1 councillor; (b) division 2—1 councillor; (c) division 3—1 councillor; (d) division 4—1 councillor; (e) division 5—1 councillor; (f) division 6—1 councillor; (g) division 7—1 councillor; (h) division 8—1 councillor; (i) division 9—1 councillor; (j) division 10—1 councillor.’. ˙ Insertion of new s 16A 8. After section 16— insert— 7 The public office of the Council of the City of Caloundra is located at 1 Omrah Avenue, Caloundra.
s9 8 s9 Local Government Legislation Amendment (No. 3) No. 299, 1996 ˙ City of Hervey Bay 16A.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of October 1996 called ‘Review of composition and divisional boundaries – City of Hervey Bay’. 8 (2) The local government area of the City of Hervey Bay is redivided into the 8 divisions shown on plan LGB62 edition 2. (3) The composition of the City of Hervey Bay is changed to the mayor and 8 other councillors. (4) The councillors of the Council of the City of Hervey Bay are assigned to the divisions as follows— (a) division 1—1 councillor; (b) division 2—1 councillor; (c) division 3—1 councillor; (d) division 4—1 councillor; (e) division 5—1 councillor; (f) division 6—1 councillor; (g) division 7—1 councillor; (h) division 8—1 councillor.’. ˙ Insertion of new s 17A 9. After section 17— insert— ˙ Shire of Kilkivan 17A.(1) This section implements the reviewable local government matter recommended in the report of the commissioner of September 1996 8 The public office of the Council of the City of Hervey Bay is located at 77 Tavistock Street, Hervey Bay.
s 10 9 s 10 Local Government Legislation Amendment (No. 3) No. 299, 1996 called ‘Abolition of divisional boundaries – Shire of Kilkivan’. 9 (2) The divisions of the local government area of the Shire of Kilkivan are abolished as shown on plan LGB73 edition 3.’. ˙ Insertion of new ss 19A–19E 10. After section 19— insert— ˙ City of Logan 19A.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of September 1996 called ‘Review of divisional boundaries – City of Logan’. 10 (2) The local government area of the City of Logan is redivided into the 10 divisions shown on plan LGB78 edition 5. (3) The councillors of the Council of the City of Logan are assigned to the divisions as follows— (a) division 1—1 councillor; (b) division 2—1 councillor; (c) division 3—1 councillor; (d) division 4—1 councillor; (e) division 5—1 councillor; (f) division 6—1 councillor; (g) division 7—1 councillor; (h) division 8—1 councillor; (i) division 9—1 councillor; (j) division 10—1 councillor. 9 The public office of the Council of the Shire of Kilkivan is located at 26 Bligh Street, Kilkivan. 10 The public office of the Council of the City of Logan is located at the corner of Wembly Road and Jacaranda Avenue, Woodridge.
s 10 10 s 10 Local Government Legislation Amendment (No. 3) No. 299, 1996 ˙ City of Mackay 19B.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of September 1996 called ‘Review of divisional boundaries – City of Mackay’. 11 (2) The local government area of the City of Mackay is redivided into the 9 divisions shown on plan LGB80 edition 3. (3) The councillors of the Council of the City of Mackay are assigned to the divisions as follows— (a) division 1—2 councillors; (b) division 2—1 councillor; (c) division 3—1 councillor; (d) division 4—1 councillor; (e) division 5—2 councillors; (f) division 6—2 councillors; (g) division 7—1 councillor; (h) division 8—1 councillor; (i) division 9—1 councillor. ˙ Shire of Mareeba 19C.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of September 1996 called ‘Abolition of divisional boundaries – Shire of Mareeba’. 12 (2) The divisions of the local government area of the Shire of Mareeba are abolished as shown on plan LGB81 edition 2. 11 The public office of the Council of the City of Mackay is located at the Sir Albert Abbott Administration Building, Gordon Street, Mackay. 12 The public office of the Council of the Shire of Mareeba is located at 65 Rankin Street, Mareeba.

(3) The councillors of the Council of the Shire of Maroochy are assigned to the divisions as follows— (a) division 1—1 councillor; (b) division 2—1 councillor; (c) division 3—1 councillor; (d) division 4—1 councillor; (e) division 5—1 councillor; (f) division 6—1 councillor; (g) division 7—1 councillor; (h) division 8—1 councillor; (i) division 9—1 councillor; (j) division 10—3 councillors. ˙ City of Maryborough 19E.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of October 1996 called ‘Review of divisional boundaries – City of Maryborough’. 14 (2) The local government area of the City of Maryborough is redivided into the 8 divisions shown on plan LGB83 edition 2. 13 The public office of the Council of the Shire of Maroochy is located at the corner of Currie and Bury Streets, Nambour. 14 The public office of the Council of the City of Maryborough is located at 431-433 Kent Street, Maryborough.

After section 21— insert— ˙ Shire of Noosa 21A.(1) This section implements the reviewable local government matters recommended in the report of the commissioner of September 1996 called ‘Review of divisional boundaries – Shire of Noosa’. 15 (2) The local government area of the Shire of Noosa is redivided into the 4 divisions shown on plan LGB100 edition 3. (3) The councillors of the Council of the Shire of Noosa are assigned to the divisions as follows— (a) division 1—3 councillors; (b) division 2—2 councillors; (c) division 3—2 councillors; (d) division 4—2 councillors. 15 The public office of the Council of the Shire of Noosa is located at 6 Pelican Street, Tewantin.

(3) The councillors of the Council of the Shire of Pine Rivers are assigned to the divisions as follows— (a) division 1—1 councillor; (b) division 2—1 councillor; (c) division 3—1 councillor; (d) division 4—1 councillor; (e) division 5—1 councillor; (f) division 6—1 councillor; (g) division 7—1 councillor; (h) division 8—1 councillor; (i) division 9—1 councillor; (j) division 10—1 councillor.’. ˙ Insertion of new s 22A 12.
