s1 2 s5 Local Government Legislation Amendment Regulation No. 233, 2004 (No. 2) 2004 Part 1 Preliminary 1 Short title This regulation may be cited as the Local Government Legislation Amendment Regulation (No. 2) 2004 . 2 Commencement This regulation commences on 1 January 2005. Part 2 Amendment of Local Government (Areas) Regulation 1995 3 Regulation amended in pt 2 This part amends the LocalGovernment(Areas)Regulation1995. 4 Amendment of s 4 (Declaration of joint local government areas) Section 4, after ‘governments in the’— insert — ‘repealed’. 5 Amendment of sch 1 (Information about local governments) (1) Schedule 1, heading, ‘section 2’— omit, insert — ‘sections 2 and 3(1)(a)’. (2) Schedule 1, entry for Crow’s Nest—

Part 3 Amendment of Local Government (Limited Reviewable Local Government Matters) Regulation 2002 6 Regulation amended in pt 3 This part amends the Local Government (Limited ReviewableLocal Government Matters) Regulation 2002. 7 Amendment of s 3 (Receiving local government) Section 3— insert — ‘(i) for the Esk/Crows Nest relevant area—the Council of the Shire of Esk; or (j) for the Crows Nest/Esk relevant area—the Council of the Shire of Crows Nest; or

s8 4 s9 Local Government Legislation Amendment Regulation No. 233, 2004 (No. 2) 2004 (k) for the Millmerran/Pittsworth relevant area—the Council of the Shire of Millmerran; or (l) for the Pittsworth/Millmerran relevant area—the Council of the Shire of Pittsworth.’. 8 Amendment of s 4 (Transferring local government) Section 4— insert — ‘ (i) for the Esk/Crows Nest relevant area—the Council of the Shire of Crows Nest; or (j) for the Crows Nest/Esk relevant area—the Council of the Shire of Esk; or (k) for the Millmerran/Pittsworth relevant area—the Council of the Shire of Pittsworth; or (l) for the Pittsworth/Millmerran relevant area—the Council of the Shire of Millmerran.’. 9 Insertion of new ss 6E and 6F Part 2— insert — ‘6E New external boundaries for the 1 January 2005 transfer day—Crows Nest and Esk local governments ‘(1) Map no. LGB40 edition 4 shows— (a) the external boundaries of the local government area of the Shire of Crows Nest with the Esk/Crows Nest relevant area excluded; and (b) the divisional boundaries of the local government area of the Shire of Crows Nest with the Esk/Crows Nest relevant area excluded from division 1 of the local government area. ‘(2) Map no. LGB50 edition 5 shows the external boundaries of the local government area of the Shire of Esk with the Esk/Crows Nest relevant area included.

LGB50 edition 5 shows the external boundaries of the local government area of the Shire of Esk with the Crows Nest/Esk relevant area excluded. ‘(4) Map no. LGB40 edition 4 shows— (a) the external boundaries of the local government area of the Shire of Crows Nest with the Crows Nest/Esk relevant area included; and (b) the divisional boundaries of the local government area of the Shire of Crows Nest with the Crows Nest/Esk relevant area included in division 1 of the local government area. ‘6F New external boundaries for the 1 January 2005 transfer day—Millmerran and Pittsworth local governments ‘(1) Map no. LGB85 edition 2 shows— (a) the external boundaries of the local government area of the Shire of Millmerran with the Pittsworth/Millmerran relevant area excluded; and (b) the divisional boundaries of the local government area of the Shire of Millmerran with the Pittsworth/Millmerran relevant area excluded from division 1 of the local government area. ‘(2) Map no. LGB106 edition 3 shows the external boundaries of the local government area of the Shire of Pittsworth with the Pittsworth/Millmerran relevant area included. ‘(3) Map no. LGB106 edition 3 shows the external boundaries of the local government area of the Shire of Pittsworth with the Millmerran/Pittsworth relevant area excluded. ‘(4) Map no. LGB85 edition 2 shows— (a) the external boundaries of the local government area of the Shire of Millmerran with the Millmerran/Pittsworth relevant area included; and (b) the divisional boundaries of the local government area of the Shire of Millmerran with the

s 10 6 s 10 Local Government Legislation Amendment Regulation No. 233, 2004 (No. 2) 2004 Millmerran/Pittsworth relevant area included in division 1 of the local government area.’. 10 Amendment of schedule (Dictionary) (1) Schedule— insert — ‘ Crows Nest/Esk relevant area means the following areas identified in the Esk/Crows Nest report as part of the local government area of the Shire of Esk— (a) the part of lot 2 on RP 54283, identified in attachment C of the report; (b) the parts of lot 12 on SP 112457, identified in attachment D of the report. Esk/Crows Nest relevant area means the parts of lot 10 on SP 117255 identified in attachment B of the Esk/Crows Nest report as part of the local government area of the Shire of Crows Nest. Esk/Crows Nest report means the report of August 2004 called ‘Local Government Electoral & Boundaries Review Commission—Report on changes to the external boundaries of the shires of Esk and Crows Nest’. Millmerran/Pittsworth relevant area means the parts of lot 3 on SP 109725 identified in attachment C of the Millmerran/Pittsworth report as part of the local government area of the Shire of Pittsworth. Millmerran/Pittsworth report means the report of August 2004 called ‘Local Government Electoral & Boundaries Review Commission—Report on changes to the external boundaries of the shires of Millmerran and Pittsworth’. Pittsworth/Millmerran relevant area means the following areas identified in attachment B of the Millmerran/Pittsworth report as part of the local government area of the Shire of Millmerran— (a) the part of lot 118 on SP 119171; (b) the part of lot 126 on SP 109721.’.
