Local Government Legislation Amendment No. 25, 1991 491 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows. PART 1-PRELIMINARY Short title 1. This Act may be cited as the Local Government Legislation Amendment Act 1991. PART 2-AMENDMENTS OF LOCAL GOVERNMENT ACT 1936 Amended Act 2. The Local Government Act 1936 is amended as set out in this Part. Amendment of s. 27 3. After section 27(4)- insert- 'LIMITATION OF INCREASE ON RATES `Power to limit increase on rates levied `(4A) A Local Authority when resolving to make and levy a rate, may resolve that, in relation to land or classes of land as it determines, the amount levied is not to exceed the amount of that rate levied for the immediately preceding year increased by a specified percentage of that levy. Different percentages may be set in relation to either or both of the following- (a) different land or classes of land; (b) different rates. '.
492 Local Government Legislation Amendment No. 25, 1991 PART 3-AMEND MENTS OF CITY OF BRISBANE ACT 1924 Amended Act 4. The City ofBrisbaneAct 1924 is amended as set out in this Part. Amendment of s. 3 ( Interpretation) 5. Section :3(1)- i nsert- ` "Leader of the Opposition "-The alderman recognised for the time being as the leader of the opposition in the Council;'. Amendment of s. 22 ( Remuneration of Mayor and aldermen) 6. (1) Section 22(1), second paragraph- omit subparagraph (iii), substitute- '(iia) The Leader of the Opposition; (lib) The chairperson of the Council; (iii) The respective chairpersons of Standing Committees of the Council;'. (2) Section 22(1), second paragraph proviso- omit `chairman' occurring 4 times, insert `chairperson' in each case. Amendment of s. 44A 7. After section 44A(2)- insert- 'Power to limit increase on rates levied `(2A) The Council, when resolving to make and levy a rate in respect of a specified year, may resolve that, in relation to land or classes of land as it determines, the amount levied is not to exceed the amount of that rate levied for the year immediately preceding the specified year increased by a specified percentage of that levy.

Insertion of new heading and s. 44B 8. After section 44A- insert- 'CHARGES AND FEES `Charges and fees '44B. The Council may, in the performance of the functions of local government authorised by this Act or any other Act, fix by ordinance or by resolution and may make, levy, demand, and recover charges and fees when the Council- (a) supplies any service, product or commodity; or (b) makes any registration; or (c) grants any licence; or (d) gives any permission; or (e) furnishes any information; or (f) admits to any building or enclosure; or (g) receives any application for its approval.
