Queensland Local Government Grants Commission Amendment Act 1992 Act No. 5 of 1992 An Act to amend the Local Government Grants Commission Act 1976 [Assented to 27 March 1992]

2 Local Government Grants Commission Amendment No. 5, 1992 BE IT ENACTED by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows. Short title 1. This Act may be cited as the Local Government Grants Commission Amendment Act 1992 . Amended Act 2. The Local Government Grants Commission Act 1976 is amended as set out in this Act. Replacement of s.3 (Interpretation) 3. Section 3— omit, insert— ‘Definitions ‘3. In this Act— “Commission” means the Local Government Grants Commission; “local governing body” has the meaning given by the relevant Commonwealth Act; “member” means a member of the Commission, and includes the deputy of a member; “relevant Commonwealth Act” means the Local Government (FinancialAssistance) Act 1986 of the Commonwealth. ’. Replacement of s.5 (Members of the Commission) 4. Section 5— omit, insert — ‘Members of the Commission

3 Local Government Grants Commission Amendment No. 5, 1992 ‘5.(1) The Commission is to consist of 5 members of whom— (a) 4 are to be persons possessing knowledge of local government; and (b) one is to be an officer of the department. ‘(2) The chairperson is to be a member mentioned in subsection (1)(a), and the deputy chairperson is to be the member mentioned in subsection (1)(b). ’. Amendment of s.7 (Term of appointment of members) 5. Section 7(2)— omit ‘ nomination and ’. Amendment of s.8 (Vacation of office by member) 6. Section 8(1)(f)— omit ‘ Local Government Department ’, insert ‘ department ’. Amendment of s.9 (Filling of casual vacancies) 7. Section 9(3)— omit ‘ shall be nominated and ’, insert ‘ is to be ’. Amendment of s.10 (Deputies) 8.(1) Section 10(3) and (7)— omit ‘ Local Government Department ’ (wherever occurring) , insert ‘ department ’. (2) Section 10(3) and (4)— omit ‘ Director ’, insert ‘ chief executive of the department ’.
