Her Excellency the Governor, with the advice of the Executive Council, has made the following

Explanatory note

The object of this Regulation is to extend, for a period of six months until 31 December 2020, the exemption from tendering requirements under the Local Government Act 1993 that applies to contracts up to a value of $500,000 for the purposes of bush fire-related response and recovery.

This Regulation is made under the Local Government Act 1993, including sections 55(3)(n)(i) and 748 (the general-regulation making power) and clause 5 of Schedule 6.

1      Name of Regulation

This Regulation is the Local Government (General) Amendment (Tendering)

Regulation (No 2) 2020.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Local Government (General) Regulation 2005

Clause 170A Prescribed expenditure to assist councils with bush fire-related response and recovery

Omit “1 July 2020” from clause 170A(a). Insert instead “31 December 2020”.
