Local Government (General) Amendment

(Tendering) Regulation 2020

His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Local Government Act 1993.

Explanatory note

The object of this Regulation is to prescribe an amount of $500,000 as exempt from the tendering requirements that councils must comply with under the Local Government Act 1993 for contracts entered into for the purpose of bush fire-related response and recovery.

This Regulation is made under the Local Government Act 1993, including sections 55(3)(n)(i) and 748 (the general-regulation making power) and clause 5 of Schedule 6.

1      Name of Regulation

This Regulation is the Local Government (General) Amendment (Tendering)

Regulation 2020.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Local Government (General) Regulation 2005

Clause 170A

Insert after clause 170—

170A Prescribed expenditure to assist councils with bush fire-related
response and recovery

For the purposes of section 55(3)(n)(i) of the Act, an amount of

$500,000 is prescribed but only in the case of a contract that—

(a) is entered into between 17 January 2020 and 1 July 2020, and
(b) is primarily for the purpose of bush fire-related response and recovery.
