Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Local Government Act 1993.

Explanatory note
Section 55 of the Local Government Act 1993 requires a council to invite tenders before entering into certain contracts. However, section 55 (3) of that Act enables contracts to be excluded from the tendering requirements. These include contracts for the purchase of goods, materials or services specified by a prescribed person.
The object of this Regulation is to prescribe MAPS Group Limited trading as Strategic Purchasing (ABN 45 058 335 363) for the purposes of section 55 (3) of the Local Government Act 1993. The prescription includes any duly appointed agent of Strategic Purchasing.
This Regulation is made under the Local Government Act 1993, including sections 55 and 748 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Local Government (General) Amendment
(Tendering) Regulation 2010.
2 Commencement
This Regulation commences on the day on which it is published on the
NSW legislation website.
3 Amendment of Local Government (General) Regulation 2005
Clause 163 Application of Part
Omit clause 163 (1A) and (1B). Insert instead:
(1A) The following persons are prescribed for the purposes of the first bullet point paragraph of section 55 (3) of the Act:
(i) Local Government Procurement Partnership
(ABN 34 578 553 267),(ii) MAPS Group Limited trading as Strategic Purchasing (ABN 45 058 335 363). (1B) To avoid doubt, a reference to a person prescribed by subclause (1A) includes any duly appointed agent of that person.
