Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Local Government Act 1993.

Explanatory note
The object of this Regulation is to amend the Local Government (General) Regulation 2005 to enable an employee of a council who is entitled to long service leave on ordinary pay to take that leave on a half pay or double pay basis, but only with the consent of the council.

This Regulation is made under the Local Government Act 1993, including section 748 (the general regulation-making power) and clause 15 of Schedule 6.

1      Name of Regulation

This Regulation is the Local Government (General) Amendment (Long
Service Leave) Regulation 2011.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Local Government (General) Regulation 2005

Clause 406B

Insert after clause 406A:

406B Long service leave entitlements

An employee of a council who is entitled to any period of long service leave on ordinary pay may, with the consent of the council, take that entitlement:

(a) as leave for twice that period on half pay, or
(b) as leave for half that period on double pay.
