Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Local Government Act 1993.

Explanatory note
The object of this Regulation is to prescribe a model code of conduct for local councils in New South Wales together with a model procedure for administering that code. Under the Local Government Act 1993, each council is required to adopt a code of conduct and procedure that incorporate the provisions of the prescribed model code and model procedure. This Regulation is made under the Local Government Act 1993, including sections 440 (1), 440AA (1), 440L (7), and 748 (the general regulation-making power).

1 Name of Regulation
This Regulation is the Local Government (General) Amendment
(Conduct) Regulation 2012.
2 Commencement
This Regulation commences on 1 March 2013 and is required to be published on the NSW legislation website.
3 Amendment of Local Government (General) Regulation 2005
(1) Clause 193 Omit the clause. Insert instead:
193 Model code of conduct and model procedure
(1)
For the purposes of section 440 of the Act, the document entitled The Model Code of Conduct for Local Councils in NSW published in the Gazette on 7 December 2012 is prescribed as the model code of conduct.
(2)
For the purposes of section 440AA of the Act, the document entitled Procedures for the Administration of the Model Code of Conduct for Local Councils in NSW published in the Gazette on 7 December 2012 is prescribed as the model procedure.
(2) Clause 195 Making of appeal Omit “section 440M”. Insert instead “section 440L”.
